APPLICANT REQUESTS THAT:

He be given credit for Temporary Duty (TDY) to Vietnam and that he  be
awarded the Vietnam Service Medal.

APPLICANT CONTENDS THAT:

In March 1972, his unit went TDY to Southeast Asia.  However,  he  did
not complete the TDY because he returned to the United States due to a
“hardship” in May 1972.

In support of his request, the applicant submits, through a Member  of
Congress, a copy  of  his  DD  Form  214.   The  applicant’s  complete
submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant contracted his  enlistment  in  the  Regular  Air  Force  on
6 March 1969 for  a  period  of  four  years.   He  was  progressively
promoted to the grade of staff sergeant (E-5), with an effective  date
and date of rank of 1 October 1972.  He was released from active  duty
and transferred to the Air Force Reserve (Obligated  Reserve  Section)
on 18 January 1973.  He had completed a total of 3  years,  10  months
and 12 days and was serving in  the  grade  of  E-5  at  the  time  of
separation.  On 8 January 1975, the applicant was  relieved  from  his
Reserve  assignment  (Obligated   Reserve   Section)   and   honorably
discharged from the Air Force Reserve.

AIR FORCE EVALUATION:

HQ AFPC/DPAPP2 recommends the application be  denied.   DPAPP2  states
there are no records in the applicant’s Military Personnel Records  to
verify he was TDY to Vietnam.  The applicant did not respond to  their
request for additional documents to support his claim.   DPAPP2  noted
that the applicant’s records reflected his TDY to Germany  and  France
for a period of 51 days during 1970  and  1971.   The  HQ  AFPC/DPAPP2
evaluation, with attachment, is at Exhibit C.

Examiner’s Note:  The applicant’s  records  will  be  administratively
corrected to reflect his European foreign service credit.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded  to  applicant  on  4
February 2005 for review and response.  As of this date,  no  response
has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was not  timely  filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case.
However,  we  agree  with  the  opinion  and  recommendation   of   HQ
AFPC/DPAPP2 and adopt the rationale expressed as  the  basis  for  our
decision that the applicant has failed to sustain his burden  that  he
has suffered either an error or an injustice.  Inasmuch as  there  was
no evidence the applicant ever served in or was TDY to Vietnam, he was
asked to provide additional information to confirm his TDY to Vietnam,
but he has failed to do so.  In view of the above and absent  evidence
to the contrary, we find no basis to  recommend  granting  the  relief
sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
