His records be corrected to reflect award of the Vietnam Service Medal
(VSM).

APPLICANT CONTENDS THAT:
He served in South Vietnam from January through May 1966. He wishes
to join the Veterans of Foreign Wars (VFW).

STATEMENT OF FACTS:
The applicant served on active duty from 23 August 1963 through 22
June 1967. His records reflect he had an overseas tour in Misawa Air
Base, Japan from 14 September 1965 through 21 June 1967. His records
reflect he was awarded the Air Force Good Conduct Medal (AFGCM) and
the National Defense Service Medal (NDSM).

AIR FORCE EVALUATION:
HQ AFPC/DPAPP2 states a review of the applicant’s records does not
confirm he had a Temporary Duty (TDY) to Vietnam. The applicant’s
Airman Performance Reports rendered during 1966 makes no reference to
the applicant being TDY in Vietnam. However, his records did reflect
a tour of duty at Misawa AB. On 27 April 2004, HQ AFPC/DPAPP1
requested the applicant provide any documents to verify he was TDY in
Vietnam. The applicant did not respond.
DPAPP2 further states without military source documents to verify the
applicant was TDY in Vietnam, his eligibility for VSM cannot be
verified. They recommend the applicant’s request be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 9
July 2004, for review and response. As of this date, no response has
been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinions and the recommendations of the Air
Force and adopt their rationale as the basis for our conclusion the
applicant has not been the victim of an error or an injustice. The
applicant's records do not reflect temporary duty (TDY) or a permanent
change of station to Vietnam. The applicant was requested to provide
any documentation to support his claim; however, as of this date, he
has not provided any documentation to verify he was assigned or TDY in
Vietnam and therefore his eligibility for the Vietnam Service Medal
cannot be verified. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

On 22 July 2003, HQ AFPC/DPAPP2 advised the applicant there were no documents in his personnel file that reflected he was on temporary duty (TDY) to Vietnam. They indicated that they have thoroughly reviewed the applicant’s records and they are unable to find any indication that he was TDY from the Philippines to Vietnam at any time. His assignment to Thailand is after the closeout date for award of the Vietnam Service Medal.

His Air Force Form 7 does show he was TDY to Southeast Asia for a total of 97 days during 1969. Although the applicant provided no evidence to show actual locations while TDY to Southeast Asia (SEA), it was noted that his DD Form 214 reflects award of the Vietnam Service Medal (VSM) and the Republic of Vietnam Campaign Medal (RVCM). The DVA denied his request because his military records reflect service in Southeast Asia (SEA), but not specifically in Vietnam.
