APPLICANT REQUESTS THAT:
He be considered for “Senior School Candidacy” (SIC) by a Special
Selection Board (SSB) for the Calendar Year 2003A (CY03A)
Lieutenant Colonel Central Selection Board with the inclusion of
his Officer Performance Report (OPR) closing 23 May 2003.

APPLICANT CONTENDS THAT:
He was informed by AFMPC Officer Promotions that his 23 May 2003
OPR was not in his records due to an administrative error by his
higher headquarters.
Applicant’s complete submission is attached at Exhibit A.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the
grade of major.
Applicant was considered and selected for promotion to the grade of
lieutenant colonel by the Calendar Year 2003A Lieutenant Colonel
Central Selection Board.

AIR FORCE EVALUATION:
AFPC/DPPPO recommended denial and indicated AFI 36-2406, para
3.8.5.6, Officer and Enlisted Evaluation Systems, states that OPRs
on extended active duty officers are due at AFPC no later than 60
days following closeout of the report. The applicant’s OPR that
closed out on 23 May 2003 was not required to be file until 23 July
2003 (board convened on 8 July 2003). Since many board eligible
officers fall into this predicament, approving SSB consideration
with a report not required to be on file would generate unfairness
in the current promotion process. Furthermore, they note that the
reviewer signed the report on 31 July 2003 after convening of the
board, thus the report would not have been a matter of record by
the board convening date.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 19 November 2004 for review and response within 30 days. As of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we
agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt its rationale as the basis for our
conclusion that the applicant has not been the victim of an error or
injustice. In this respect, we note that in accordance with applicable
Air Force instructions, the OPR closing on 23 May 2003 was not required
to be on file at AFPC until after the date the Lieutentant Colonel
Central Selection board adjourned. Therefore, in the absence of
persuasive evidence that the appropriate standards were not applied in
this case, we find no compelling basis to recommend granting the relief
sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of a material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
