APPLICANT REQUESTS THAT:

His record, to include the Officer Performance Report (OPR) closing 27  June
2003 and the Bronze Star Medal (BSM), be considered  for  promotion  to  the
grade of lieutenant colonel by a  Special  Selection  Board  (SSB)  for  the
Calendar Year 2003A (CY03A) Lieutenant Colonel Central Selection Board.

THE APPLICANT CONTENDS THAT:

An OPR and BSM completed after his participation in Operation Iraqi  Freedom
(OIF) were not available for the CY03A board, which significantly  hurt  his
chances for promotion.  The BSM highlighted accomplishments  the  Board  did
not have knowledge of.  Due to administrative oversight and  the  deployment
of his entire rating chain to OIF, there was no  OPR  prepared  between  the
CY02B and CY03A boards.

STATEMENT OF FACTS:

The applicant is currently serving on extended active duty in the  grade  of
major.

He was considered and not selected for promotion to the grade of  lieutenant
colonel by  the  CY02B  Lieutenant  Colonel  Central  Selection  Board  that
convened on 12 November 2002.

On 24 April 2003, he was awarded the BSM for meritorious achievement  during
the period 19 March 2003 to 23 April 2003.

He was considered and not selected for promotion to the grade of  lieutenant
colonel by  the  CY03A  Lieutenant  Colonel  Central  Selection  Board  that
convened on 8 July 2003.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the applicant receive SSB consideration with  the  BSM
in his Officer Selection Record (OSR) since it was  approved  prior  to  the
convening of the CY03A board.  However, since the OPR was  not  required  to
be filed in his OSR until after the CY03A  board  convened,  they  recommend
denial of his request to include the report in his OSR for the CY03A board.

The AFPC/DPPPO evaluation, with attachments, is at Exhibit C.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air Force evaluation was forwarded to  the  applicant
on 6 February 2004 for review and response within 30 days.  However,  as  of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of error or injustice  to  warrant  the  applicant  receiving  SSB
consideration with the BSM in his OSR.  Although the BSM was approved  prior
to the convening of the CY03A board, it was  not  filed  in  his  OSR  until
after the CY03A board  convened.   In  view  of  this,  we  agree  with  the
recommendation of AFPC/DPPPO that applicant’s records be  corrected  to  the
extent indicated below.  However, since the OPR closing 27  June  2003,  was
not required to be filed in his OSR until after the  CY03A  board  convened,
we find no basis upon which to include the report in his OSR for  the  CY03A
board.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT, to include the Bronze Star Medal for the period 19 March  2003
to 23 April 2003, be considered for promotion to  the  grade  of  lieutenant
colonel by Special Selection Board  for  the  Calendar  Year  2003A  Central
Lieutenant Colonel Selection Board and any subsequent boards for  which  the
above award was not a matter of record.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to XXXXXXX, XXXXXXX, to include the Bronze Star Medal awarded for
the period 19 March 2003 to 23 April 2003, be considered for promotion to
the grade of lieutenant colonel by Special Selection Board for the Calendar
Year 2003A Central Lieutenant Colonel Selection Board and any subsequent
