APPLICANT REQUESTS THAT:

His records, to include the citation to accompany award of  the  Meritorious
Service Medal,  First  Oak  Leaf  Cluster  (MSM,  1  OLC),  and  an  Officer
Selection Brief  (OSB)  reflecting  his  board  certification  in  Emergency
Medicine from 1996, his Master of Public Health in June 2003,  his  election
to the honorary society for Public  Health  for  academic  achievement,  his
1976 commission, his completion of three short tours, and his completion  of
3000 flying hours, be considered for promotion by a Special Selection  Board
(SSB) for  the  Calendar  Year  2003A  (CY03A)  Medical  Corps/Dental  Corps
Colonel Central Selection Board.

Applicant also  contests  his  last  three  Promotion  Recommendation  Forms
(PRFs); however, he has not requested any specific form of relief.

THE APPLICANT CONTENDS THAT:

His records contained numerous errors at the  time  he  was  considered  for
promotion by the CY03A board.  His 2002 and 2003 PRFs are  virtually  carbon
copies of each other.  In addition, the  2002  PRF  bears  scant  difference
from the PRF prepared in 2001.  None of the PRFs  mention  the  achievements
for which he was awarded the MSM.

STATEMENT OF FACTS:

Applicant was considered  and  not  selected  by  the  Calendar  Year  2003A
(CY03A) Medical Corps/Dental Corps Colonel Central Selection Board.

AIR FORCE EVALUATIONS:

AFPC/DPAMF2 states, in part, that applicant’s CY03A OSB reflects  his  board
certification in Emergency Medicine from 1996 and there is  no  evidence  he
ever had his MPH updated prior to the selection board.  His election to  the
honorary society for  Public  Health  for  academic  achievement  would  not
appear on the OSB or in his official record unless documented on an  Officer
Performance Report (OPR) or PRF.  Further, he needs to have his  MPH  degree
updated.

The AFPC/DPAMF2 evaluation is at Exhibit C.

AFPC/DPPPE  states,  in  part,  that  they   are   unable   to   provide   a
recommendation because applicant does not specify  exactly  what  remedy  he
desires for the contested PRFs.

The AFPC/DPPPE evaluation is at Exhibit D.

AFPC/DPPPO recommends applicant’s request for SSB  consideration  be  denied
and states, in part, that  applicant’s  MSM,  1  OLC,  was  in  his  Officer
Selection Record (OSR) for the CY03A board.  AFPC/DPPPO notes that  officers
eligible for promotion are  provided  with  an  Officer  Preselection  Brief
(OPB) several  months  prior  to  the  selection  board  and  instructed  to
carefully examine the brief for completeness and  accuracy.   Applicant  has
not provided any documentation to substantiate  what  corrective  action  he
took prior to the  board  to  ensure  his  OSB  reflected  his  MPH  degree.
Further, officers are not to be considered  by  an  SSB  if,  in  exercising
reasonable diligence, the officers  should  have  discovered  the  error  or
omission in their records, and could have taken timely corrective action.

APPLICANT’S REVIEW OF AIR FORCE EVALUATIONS:

Complete  copies  of  the  Air  Force  evaluations  were  forwarded  to  the
applicant on 8  October  2004  for  review  and  response  within  30  days.
However, as of this date, this office has received no response.

ADDITIONAL AIR FORCE EVALUATIONS:

AFPC/DPAAOR states, in part, that  applicant’s  Total  Federal  Commissioned
Service Date (TFCSD) of 14 April 1976 is correct.  AFPC/DPAAOR  cannot  find
any  entry  where  the  TFSCD  is  reflecting  a  date  of  1985.   Further,
applicant’s Total Active Federal Commissioned Service  Date  (TAFCSD)  is  9
June 1985.  The TAFCSD only accounts  for  all  active  duty  service  in  a
commissioned status.

The AFPC/DPPAOR evaluation, with attachment, is at Exhibit H.

AFPC/DPAPP states, in part, that applicant is authorized award of one  short
tour based on the accumulation of  the  required  number  of  days  overseas
temporary duty (TDY).  However,  his  duty  history  does  not  reflect  any
permanent assignments in an overseas location.  Further, his  overseas  duty
selection date and short tour return date were incorrect and  were  adjusted
during the record review.

APPLICANT’S REVIEW OF ADDITIONAL AIR FORCE EVALUATIONS:

Complete copies of the additional Air Force evaluations  were  forwarded  to
the applicant on 29 December 2004 for review and response  within  30  days.
However, as of this date, this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of  error  or  injustice.   We  took  notice  of  the  applicant's
complete submission in judging the merits of the  case;  however,  we  agree
with the opinions and recommendations of the Air Force  offices  of  primary
responsibility and adopt their rationale as the  basis  for  our  conclusion
that the applicant has  not  been  the  victim  of  an  error  or  injustice
warranting SSB consideration.  Therefore, in the absence of evidence to  the
contrary, we find no compelling  basis  to  recommend  granting  the  relief
sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
