APPLICANT REQUESTS THAT:
His high year of tenure (HYT) be extended to allow him three additional
years on active duty due to his selection for promotion to staff
sergeant (SSgt) after the Board’s previous decision, which allowed him
to test for promotion. This will allow him to pin on his promotion to
SSgt.

RESUME OF CASE:
On 10 Sep 03, the Board denied the applicant’s request to restore him
to the grade of SSgt with his original date of rank (DOR) of 1 Dec 92.
However, the Board did grant the applicant the opportunity to regain
his grade through the normal process of testing in the weighted airman
promotion system. The applicant tested and was selected for promotion
with a line number of 11726, which is projected to pin on sometime
between June and August 2005. The applicant’s mandatory date of
separation, due to his HYT, is 14 Feb 05. He was granted a one-month
extension to 14 Mar 05 by the Air Force. In a letter dated 14 Feb 05,
the applicant requested his HYT be extended for a period of three years
(Exhibit I).

THE BOARD CONCLUDES THAT:
Based on our previous decision to allow the applicant the opportunity
to regain his grade of SSgt through the normal competitive process, we
believe he should be allowed sufficient additional time on active duty
to assume the higher grade. However, after considering the
circumstances that led to his loss of rank and the fact the Air Force
is not currently considering HYT extensions, we do not believe he
should be granted a period of three years as he has requested. To
grant his request as stated would provide an unfair entitlement not
being extended to others in the Air Force. We believe a one-year
extension of his HYT is appropriate and will provide him sufficient
time to assume the grade of SSgt and prepare for his retirement and
transition from the Air Force. Therefore, we recommend his records be
corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that competent authority
approved a waiver of his High Year of Tenure as an exception to policy,
thereby establishing his date of separation as 28 February 2006.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to show that
competent authority approved a waiver of his High Year of Tenure as
an exception to policy, thereby establishing his date of separation
as 28 February 2006.

However, the Board decided to grant the applicant a measure of relief based on clemency and promoted him to the grade of senior airman with a DOR of 1 Oct 03, which allowed him an opportunity to test for promotion to the grade of SSgt and allow him to retire in that grade. He states that at the time he was considered for promotion to MSgt, he had more than 12 months left until retirement. Counsel opines that based on the stipulations in AFI 36-2502 and AFRC 36-2102, the Air Force could have, and should have, granted the applicant the promotion to master sergeant (MSgt).
