APPLICANT REQUESTS THAT:
He be awarded the Armed Forces Expeditionary Medal (AFEM).

APPLICANT CONTENDS THAT:
438 Aerial Port Squadron supported the 21st Air Force Headquarters in
both conflicts. He was assigned to the 438 APS at that time.
In support of the appeal, applicant submits a copy of a citation to
accompany the award of the Air Force Commendation Medal (First Oak
Leaf Cluster).

STATEMENT OF FACTS:
The applicant served on active duty during the period 10 August 1983
to 15 May 1986, with assignment to Turkey during the period 30
December 1981 to 25 December 1982.
On 29 July 2003, DPPPR gave the criteria for the AFEM to the applicant
and asked him to provide a copy of the TDY order(s) and Travel
Voucher(s) to show that he was in Lebanon (1 June 1983 to 1 December
1987) or Grenada (23 October 1983 to 21 November 1983) or withdraw his
application, but he did not respond.

AIR FORCE EVALUATION:
AFPC/DPPPR states that there is no indication in the applicant’s
records that he was deployed to either Lebanon or Grenada, and he did
not provide any documents to substantiate his claim. Therefore, they
are unable to verify his eligibility for award of the AFEM. They
recommend denial of applicant’s request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 3 October 2003, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and the recommendation of the Air Force and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or an injustice. The applicant did not provide any documentation showing he was assigned or TDY to Korea. There is no documentation in the applicant’s military records to reflect he was assigned or TDY to Korea.
