APPLICANT REQUESTS THAT:

He be awarded the Combat Action Ribbon and the Purple Heart (PH) Medal
for action in World War II and the Korean War.

APPLICANT CONTENDS THAT:

Applicant submitted no contentions.

In support of his  request,  applicant  submits  copies  of  his  Army
Honorable  Discharge  certificate,  Enlisted  Record  and  Report   of
Separation Honorable Discharge and a letter from  the  Douglas  County
Veterans Service Office.

Applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant served on active duty during the period 16 November 1942  to
11 August 1945, with a tour in the European Theater  from  17  January
1945 to 27 May 1945.  He also served on active duty from 23 April 1948
to 5 December 1949 and from 6 December 1949 to 1 July 1954.  His first
Report of Separation was missing the Good Conduct  Medal,  with  three
bronze loops, American Campaign Medal, and World War II Victory Medal,
and these have been added to his DD Form 214. .

On 19 June 1954, the applicant request for a Tender  of  Unconditional
Resignation was approved in accordance with AR 615-365, Convenience of
the Government with an Honorable Discharge certificate.

AIR FORCE EVALUATION:

AFPC/DPPPR  recommended  denial  and  stated  the  applicant  has  not
provided any information or documentation to show his  claim  that  he
was wounded by enemy action during any of his enlistments, and  he  is
not eligible for the award of the CAR.

AFPC/DPPPR evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 7
November 2003 for review and comment within 30 days.  As of this date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant’s complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and  adopt  their  rationale  as  the
basis for our conclusion that the applicant has not been the victim of
an error or  injustice.   In  this  respect,  the  applicant  was  not
eligible for the award of the Combat Action Ribbon.   However,  should
he secure supporting documentation from his medical records, from  the
Veterans Administration, or an account  from  an  individual  who  eye
witnessed  his  injuries,  we  would  be  willing  to  reconsider  his
applicant  for  the  Purple  Heart.   Otherwise,  without   persuasive
evidence that he was wounded as a direct result of  enemy  action,  we
find no compelling basis to warrant favorable  consideration  of   his
applicant.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
