APPLICANT REQUESTS THAT:
His non-selections for promotion to the grade of major by the FY03 and
FYO4 Line and Health Professions Major Selection Boards be set aside.

APPLICANT CONTENDS THAT:
He was in the Inactive Ready Reserve (IRR) from Jan 01 through Dec 02
and could not effectively compete for promotion during that time, as
he did not have any current Officer Performance Reports (OPRs). He
has been actively participating since Jan 03 as an executive officer
and will have a new OPR with which to compete prior to the next
promotion board.
In support of his appeal, the applicant has provided a copy of his
Point Credit History/Summary for the period 22 January 2001 through 24
January 2003.

STATEMENT OF FACTS:
The applicant, currently serving with the ---th Mission Support Group
at McChord AFB, WA, was previously considered and non-selected by the
FY03 Line and Health Professions Major (Other than Selected Reserve)
Selection Board and the FY04 Line and Health Professions Major
(Selected Reserve) Selection Board. He was selected by the February
2003 Captain’s Continuation Board. As a result, he will not be
removed from the Reserve Active Status List (RASL) and his Mandatory
Separation Date (MSD) was extended to January 2011 and, will be
considered by future selection boards until either he reaches his MSD
or he is selected and promoted to major.

AIR FORCE EVALUATION:
ARPC/DPB recommends denial. The applicant was appropriately
considered and not selected by the FY03 and FY04 major boards. As he
is in a continued status, he will not be removed from the RASL until
the end of his continuation period and has the opportunity to
demonstrate his potential to serve as major and receive officer
performance reports for any future selection boards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
18 July 2003 for review and comment within 30 days. As of this date,
no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we note that the applicant was considered and selected by the
February 2003 Captain’s Continuation Board that enables the applicant
to effectively compete for promotion to major until 31 January 2011.
Consequently, we agree with the opinion and recommendation of the Air
Force office of primary responsibility and adopt their rationale as
the basis for our conclusion that the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

His commander received an informal email in late November 2002 requesting that an Officer Performance Report (OPR) be prepared for the February 2003 major board. Since he is no longer a member of the Air Force Reserve as a result of the two nonselections, he is not eligible for consideration by a Reserve promotion board. All of the officers selected for promotion by the FY03 board had completed SOS and 94% of the officers selected by the FY04 board had completed SOS.
