APPLICANT REQUESTS THAT:

She be considered for promotion to the grade of  major  by  a  Special
Selection Board (SSB) for the FY04 Line and Health  Professions  Major
Position Vacancy Selection Board, with her Officer Performance  Report
(OPR), closing 16 February 2003, as part of  his  Promotion  Selection
Folder.

APPLICANT CONTENDS THAT:

Her OPR, closing 16 February 2003, was  not  completed  by  3 February
2003, the date the selection board convened.

In support of her request, applicant submits an  e-mail  to  SAF/MRBR,
dated 19  June  2003,  and  a  copy  of  the  OPR  in  question.   The
applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant’s Total Federal Commissioned Service Date (TFCSD) is  17
February 1994.

The applicant was appointed a second lieutenant, Reserve  of  the  Air
Force, on 17 February 1994.  She has been  progressively  promoted  to
the grade of captain, effective and with a date of rank of  8  October
1998.  The following is a resume of her OPR ratings subsequent to  her
promotion to that grade.

AIR FORCE EVALUATION:

HQ ARPC/DPB recommends the application be denied.  DPB stated that the
OPR in question closed out 16  February  2003,  two  weeks  after  the
selection board convened on 3 February 2003.  Final  scoring  for  the
FY04 Line and Health  Professions  Major  Position  Vacancy  Selection
Board was completed on 6 February 2003.  The OPR in question  was  not
due for placement in the applicant’s  selection  folder  and  was  not
eligible for consideration by this board because it closed  out  after
the selection board adjourned.  DPB indicated that the  applicant  did
receive a Promotion Recommendation (PRF), which was in her record when
viewed by the selection board.   The  HQ  ARPC/DPB  evaluation  is  at
Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force  evaluation  was  forwarded  to  applicant  on
11 July 2003 for review and response.  As of this  date,  no  response
has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case.
However, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt the rationale expressed  as
the basis for our decision that the applicant has  failed  to  sustain
her burden that she has suffered either an error or an injustice.   In
this respect, we note that the Officer  Performance  Report  (OPR)  in
question was her annual report, with the closing date of  16  February
2003.  Inasmuch as the OPR closed out after the FY04 Line  and  Health
Professions Major Position Vacancy Selection Board adjourned,  it  was
not eligible for consideration by this selection board.   In  view  of
the above and absent evidence to the contrary, we find  no  compelling
basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
