APPLICANT REQUESTS THAT:

She be reconsidered for a position vacancy promotion to major for  the
Nurse Corp, Board ID U0404A.

APPLICANT CONTENDS THAT:

Due to administrative error her record was not forwarded or considered
by the U0404A Board.  Her supervisor and Senior Rater did not  receive
the promotion package and  therefore  a  PRF  was  not  submitted  for
consideration for the February 2003 Board.

In support of the appeal, applicant submits a  personal  statement,  a
copy 11 WG/CVR’s Letter of Explanation, and a copy of her PRF package.

STATEMENT OF FACTS:

The applicant is currently serving in the Air Force  Reserves  in  the
grade of captain.

The applicant was not nominated by  her  senior  rater  for  promotion
consideration by the FY04 Line and Health Professions  Major  Position
Vacancy (PV) Selection Board, which convened at  HQ  ARPC  3  February
2003.

The letter from 11th  WG/CCVR  clearly  states  the  applicant’s  name
appeared on the management eligibility listing  (MEL)  for  both  11th
Wing and her  PAS  of  attachment  at  Lackland.   The  servicing  MPF
(Lackland) would provide the senior rater the information.

The ARPC Memorandum (ARPCM 02-12, dated 13 August 2002) announcing the
convening  of  the  selection  board  was  released  to  all  Military
Personnel Flights (MPF) in the Air Force.

Applicant’s Officer Performance Reports (OPRs) from 1996 through  2003
reflect meets standards on all performance factors.

AIR FORCE EVALUATION:

ARPC/DPB states recommends denial.  Requirements for submission of  PV
nominations were established and published four months  prior  to  the
suspense date.  Adequate advanced notice was provided to all  MPFs  so
any officer could be nominated and that  nomination  received  by  the
established suspense date.

A complete copy of the evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant reviewed the Air Force evaluation and states that  while  it
spells out the actual policy and requirements  for  submission  of  PV
nominations, adequate advanced notice was in fact not received by  her
senior rater and in turn the nomination and PRF was not submitted in a
timely manner.  Her record was not  forwarded  or  considered  by  the
U0404A Major’s Board due to administrative errors.  Her supervisor  at
the Air Force Force Protection Battlelab (AFFPB) and senior rater  did
not receive  the  promotion  package  and  therefore  a  PRF  was  not
submitted for consideration for the 3 February 2003 board.

Upon notification  to  and  review  by  ARPC  and  the  Chief  Reserve
Personnel Support Office, it was discovered the promotion notification
process did not work the way it was supposed to.  The correct  process
is for Reserve Personnel Support Office to notify the senior raters on
all of the  eligible  members  by  sending  a  copy  of  the  member’s
promotion package (ROP, DQHB, PRF  shell)  to  the  senior  rater  and
tracking the PRF.  The  member’s  servicing  MPF  is  responsible  for
forwarding the eligible officer’s Officer Pre-selection  Brief  (OPB).
Unfortunately this did not happen.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been presented  to  demonstrate
the existence of error or injustice warranting her  consideration  for
promotion to the Reserve grade of major by Special Review Board (SRB).
 In this respect, we note that the applicant was eligible for the FY04
Line and Health Professions  Major  Position  Vacancy  (PV)  Selection
Board which convened on    3  February  2003;  however,  she  was  not
nominated by  her  senior  rater  for  promotion  consideration.   The
applicant’s supervisor and  Senior  Rater  has  provided  a  statement
indicating that the applicant was not identified to HQ XOF as eligible
for the Position Vacancy Board.  Had she  been  identified,  he  would
have  submitted  her  for  consideration.   Since  the  delay  in  the
processing of the promotion notification process  was through no fault
of the applicant, we believe the promotion package and the PRF  should
be considered in the promotion process for Position Vacancy  to  Major
for the Nurse Corps Board ID  U0404A.   Therefore,  we  recommend  her
records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected by:

        a.  Providing her senior rater, at the time of the  FY04  Line
and Health Professions Major Position Vacancy (PV) Selection Board, an
opportunity to prepare an AF Form 709, Promotion Recommendation Form.

        b.  Providing her consideration promotion to the Reserve grade
of major by a Special Review Board; that her record  be  evaluated  in
comparison with the records of officers who were and were not selected
by the FY04 Line and Health Professions Major  Position  Vacancy  (PV)
Selection Board.

        c.  Providing the  recommendation(s)  of  the  Special  Review
Board to the Air Force Board for Correction of Military Records at the
earliest practicable  date  so  that  all  necessary  and  appropriate
actions may be completed.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to, be corrected by:

                  a.  Providing her senior rater, at the time  of  the
FY04 Line and Health Professions Major Position Vacancy (PV) Selection
Board,  an  opportunity  to  prepare  an  AF   Form   709,   Promotion
Recommendation Form.

                  b.  Providing her  consideration  promotion  to  the
Reserve grade of major by a Special Review Board; that her  record  be
evaluated in comparison with the records of officers who were and were
not selected by the FY04 Line and Health  Professions  Major  Position
Vacancy (PV) Selection Board.

                  c.  Providing the recommendation(s) of  the  Special
Review Board to the Air Force Board for Correction of Military Records
at the earliest practicable date so that all necessary and appropriate
actions may be completed.
