APPLICANT REQUESTS THAT:
His Officer Selection Brief (OSB) for the CY02B Lieutenant Colonel
Selection Board be corrected to reflect his degree of Master of Business
Administration (MBA) and that he receive Special Selection Board (SSB)
consideration for promotion to the grade of lieutenant colonel for the
Calendar Year CY02B Selection Board.

APPLICANT CONTENDS THAT:
He graduated with an MBA in Military Management on 29 August 2002. The
university sent notification of graduation to the Air Force Institute of
Technology (AFIT) in early October 2002. He attempted to contact AFIT by
both voice mail and email numerous times to ascertain if the degree was
included in his records, but he received no response. He deployed to
OPERATION ENDURING FREEDOM on 28 October 2002 for three months. Upon
return, he discovered that his transcripts had not been received by AFIT
and his master’s degree was not included in the package sent to the
promotion board.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the grade of
major.
Applicant was considered and not selected for promotion to the grade of
lieutenant colonel by the CY02B (12 November 2002) and CY03A (8 July 2003)
Lieutenant Colonel Central Selection Boards.
The Officer Selection Brief (OSB) prepared for the CY02B Selection Board
did not reflect his degree of Master of Business Administration; however,
it was reflected on the OSB prepared by the CY03A board.

AIR FORCE EVALUATION:
AFPC/DPPPO recommended denial. They indicated that although the applicant
would have received the Officer Pre-Selection Brief (OPB) prior to
completion of his master’s degree, it was his responsibility to ensure his
master’s degree was updated in his record. In addition to attempting to
contact AFIT, the applicant could have elected to write a letter to the
CY02B Board before his deployment on 28 October 2002, identifying the
absence of the academic degree and included copies of the transcripts.
They found no evidence he wrote any such letter to the board. The
applicant has not demonstrated he exercised “reasonable diligence” in
ensuring his records were accurate for the CY02B Board. He has not
provided any documents to substantiate the actions he took prior to the
CY02B Board to ensure the OSB reflected his master’s degree.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 15 August 2003, a copy of the Air Force evaluation was forwarded to the
applicant for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice to warrant providing the applicant
consideration by a Special Selection Board for the Calendar Year CY02B
Central Lieutenant Colonel Selection Board. Based on the evidence of
record, the applicant has established that an error existed in his record
when it was reviewed by the selection board in question. While it cannot
be conclusively determined whether or not the lack of his master’s degree
on the OSB was the reason for his nonselection, the Board believes that it
served to deprive him of fair and equitable consideration. Further, we are
persuaded that the applicant exercised due diligence in attempting to
assure AFIT received his transcript prior to his deployments. Therefore,
the Board recommends his record be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that the Officer Selection Brief (OSB)
prepared for the Calendar Year 2002B Central Lieutenant Colonel Selection
Board, be amended in the Academic Education Section to include a degree of
“Master of Business Administration” effective 2002.
It is further recommended that he be considered for promotion to the grade
of lieutenant colonel by Special Selection Board for the Calendar Year
2002B Central Lieutenant Colonel Selection Board with inclusion of the
corrected OSB.

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to , be corrected to show that the Officer Selection Brief
(OSB) prepared for the Calendar Year 2002B Central Lieutenant Colonel
Selection Board, be amended in the Academic Education Section to include a
degree of “Master of Business Administration” effective 2002.
It is further directed that he be considered for promotion to the
grade of lieutenant colonel by Special Selection Board for the Calendar
Year 2002B Central Lieutenant Colonel Selection Board with inclusion of the
