APPLICANT REQUESTS THAT:
In the applicant’s request for reconsideration, he requests additional
credit for his foreign service and that he be awarded the following
decorations: Air Force Outstanding Unit Award with Combat “V” Device,
the Vietnam Service and Campaign ribbons.

STATEMENT OF FACTS:
On 28 Mar 01, the Board considered and partially granted an
application for correction of military records pertaining to subject
applicant. Applicant requested that his DD Form 214 be corrected to
reflect award of the Purple Heart and that his foreign service be
changed to 1 year, 5 months and 14 days. The Board partially granted
applicant's request by recommending his foreign service be changed to
reflect 1 year, 2 months and 21 days. For an accounting of the facts
and the rationale of the earlier decision by the Board, see the Record
of Proceedings at Exhibit G.
The applicant submitted a request for reconsideration, contending that
he was overseas with the [numbered] Tactical Fighter Squadron for the
full deployment from 12/11/72 to 6/6/73. In addition, his service
records should show he was awarded the Air Force Outstanding Unit
Award with Combat “V” Device, the Vietnam Service and Campaign
ribbons. To support his assertions, the applicant provided a personal
statement and additional documents associated with the issues cited in
his contentions. The applicant’s complete submission, with
attachments, is at Exhibit H.

AIR FORCE EVALUATIONS
Pursuant to the Board’s request, the following advisory opinions were
provided.
HQ AFPC/DPAPP2 stated that the additional documentation submitted are
not documents used to verify foreign service. DPAPP2 concurs with the
advisory opinion of HQ AFPC/DPAPP1 (Exhibit C to ROP). The HQ
AFPC/DPAPP2 evaluation is at Exhibit I.
HQ AFPC/DPPPR stated that the applicant did not respond to the request
for additional information to support he was injured as a direct
result of enemy action. Hence, they stand by their previous advisory
regarding award of the Purple Heart.
DPPPR recommends the applicant’s request for award of the Republic of
Vietnam Campaign Medal (RVCM) be denied. DPPPR indicated that the
applicant’s records do not contain any documentation that states he
was in Vietnam for the required period of time to be awarded the RVCM.
In order to verify applicant’s entitlements to the RVCM, he must
provide a source document (travel voucher, TDY orders, etc.) to verify
he was in Vietnam for 6 months. The RVCM was awarded to members of
the Armed Forces of the United States who, between 1 Mar 61 and 29 Mar
73, served 6 months in South Vietnam.
DPPPR noted that the applicant was authorized the Air Force
Outstanding Unit Award (AFOUA) with “V” device, National Defense
Service Medal (NDSM), Air Force Good Conduct Medal (AFGCM) and Vietnam
Service Medal (VSM). Since the AFOUA with “V” device and the VSM were
not listed on the applicant’s DD Form 214, his DD Form 214 has been
administratively corrected to reflect award of the aforementioned
decorations.

APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS:
Having been provided the advisory opinions, the applicant submitted a
personal statement for the Board’s review in which he states his
record still lacks the additional time he spent in Southeast Asia at
Ubon, RTAFB, Thailand. His foreign service should read “1 year, 6
months and 20 days in Southeast Asia.” He has provided additional
documents in support of his claim. The applicant’s complete review,
with attachments, is at Exhibit L.

THE BOARD CONCLUDES THAT:
1. After again reviewing this application and the evidence provided
in support of the appeal, we are of the opinion that additional relief
is warranted. In this respect, we are persuaded by the preponderance
of the evidence submitted that the applicant was TDY at Ubon RTAFB for
four (4) months during the time period Dec 72 - Apr 73. In our
opinion, applicant’s Enlisted Performance Report (EPR), closing 4 May
73, verifies his deployment (TDY status) with the [numbered] Fighter
Squadron to Ubon RTAFB. We also noted that the history of the
[numbered] Fighter Squadron reveals that this squadron, while
stationed at Homestead AFB, was deployed to Ubon RTAFB during the
period Dec 72 - Jun 73. Furthermore, a former member of the
[numbered] Fighter Squadron provided a statement substantiating the
applicant’s service while TDY to Ubon RTAFB and of his early departure
from Ubon RTAFB. In view of the foregoing, we recommend the
applicant’s records be corrected to the extent indicated below.
2. With regards to the applicant’s request for award of the Republic
of Vietnam Campaign Medal (RVCM), insufficient relevant evidence has
been presented to demonstrate the existence of error or injustice. In
this respect, the evidence submitted reveals that, while the applicant
was TDY to Ubon RTAFB, he was deployed to Vietnam for a period of less
than a month as a result of an injury he sustained. Due to this
injury, the applicant’s TDY was curtailed early as indicated above.
In the absence of sufficient evidence to the contrary, the applicant
did not meet the criteria for award of the RVCM, which stipulates a
member must serve six (6) months in South Vietnam. We therefore agree
with the recommendation of the Air Force office of primary
responsibility and conclude that the applicant has failed to sustain
his burden that he has suffered either an error or injustice. In view
of the foregoing, we find no basis upon which to favorably consider
the applicant’s request for award of the RVCM. As to the applicant’s
request for award of the Vietnam Service Medal and the Air Force
Outstanding Unit Award with Valor, since this portion of the request
was administratively corrected, no Board action is required.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected by voiding the DD Form 215,
Correction to DD Form 214, Certificate of Release or Discharge from
Active Duty, issued on 10 May 01, showing he was credited with 1 year,
2 months and 21 days of foreign and/or SEA service; and, amend the DD
Form 214, Report of Separation from Active Duty, issued on 4 May 1976,
to show he was credited with 1 year, 6 months and 21 days of foreign
and/or SEA service.

of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected by voiding the DD Form 215,
Correction to DD Form 214, Certificate of Release or Discharge from
Active Duty, issued on 10 May 01, showing he was credited with 1 year,
2 months and 21 days of foreign and/or SEA service; and, amend the DD

His Air Force Form 7 does show he was TDY to Southeast Asia for a total of 97 days during 1969. Although the applicant provided no evidence to show actual locations while TDY to Southeast Asia (SEA), it was noted that his DD Form 214 reflects award of the Vietnam Service Medal (VSM) and the Republic of Vietnam Campaign Medal (RVCM).
