APPLICANT REQUESTS THAT:
His DD Form 214 be corrected to reflect award of the Southwest Asia
Service Medal (SWASM).

APPLICANT CONTENDS THAT:
He received the SWASM for his service in Saudi Arabia. The medal is
not on his DD Form 214 service record showing he is a veteran.
He believes his records should be changed due to the fact he earned
the medal.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 4 October 1993 for
a period of four years.
His DD Form 214 reflects he was awarded the Air Force Training Ribbon,
National Defense Service Medal, Air Force Outstanding Unit Award and
the Air Force Good Conduct Medal. His DD Form 214 further reflects he
had 3 months and 13 days of foreign service.
The applicant’s Enlisted Performance Report (EPR) for the period
closing 3 June 1996 indicates the applicant was TDY for 90 days and
changed assignment prior to his midterm feedback and while assigned to
the 4404th TRNS, Dhahran, Saudi Arabia, provided outstanding support
to the Southwest Asia Joint Task Force and the 4404th Wing
(Provisional) during Operation SOUTHERN WATCH. There are no further
references regarding the dates of the aforementioned TDY.
On 25 August 2003, AFPC/DPPPRA informed the applicant there was
insufficient documentation in his records to substantiate his request
for award of the SWASM. They requested he provide a copy of his
Temporary Duty (TDY) order (showing the name of the operation for
which he was deployed) and his travel voucher (showing the country and
the inclusive dates in the designated country.) The applicant did not
respond.
The applicant was involuntarily discharged with a general (under
honorable conditions) discharge on 13 May 1997 for Alcohol
Rehabilitation Failure. He served three years, seven months and ten
days of active service.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR states the award of the SWASM for participation in
Operation DESERT SHEILD/DESERT STORM closed on 30 November 1995, and
the Armed Forces Expeditionary Medal is awarded for participation in
Operation SOUTHERN WATCH beginning 1 December 1995. The determination
of which award should be considered depends on the operation for which
the servicemember was deployed and the exact dates he was in which
country. The servicemember cannot receive both medals for one
deployment. Since there is insufficient information in the
applicant’s records regarding his eligibility for the award of either
medal and since he did not respond to the request to provide
documentation to support his request, they are unable to verify his
eligibility for the SWASM. DPPPR recommends denying the requested
relief.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
15 November 2003, for review and response. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of an error or injustice. After reviewing all the
evidence presented, we believe favorable consideration of the
applicant’s request is warranted. Although the Air Force OPR stated
that there is no documentation in the applicant’s record to
substantiate his request, we are persuaded the applicant is eligible
for the SWASM. In this respect, the Defense Finance Accounting
Service (DFAS) has advised the Board that the applicant was in Saudia
Arabia from 13 September 1995 to 15 December 1995 and drew Foreign
Duty Overseas Pay and Combat Zone Hostile Fire Pay for the period
September 1995 to December 1995. Furthermore, we believe that any
doubt should be resolved in the applicant's favor. While it is noted
the EPR for the period ending 3 June 1996 indicates he was deployed
during Operation Southern Watch, for which the Armed Forces
Expeditionary Medal was awarded, we believe that based on the time
period he was deployed, it would appear he was deployed initially in
support of Operation Desert Shield/Desert Storm thereby making him
eligible for the SWASM. Therefore, we recommend his records be
corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that he was awarded the
Southwest Asia Service Medal for his service in Saudia Arabia in
support of Operation Desert Shield/Desert Storm from 13 September 1995
through 15 December 1995.
