APPLICANT REQUESTS THAT:
Item 23a of his DD Form 214, Armed Forces of the United States Report of
Transfer of Discharge, be corrected to reflect that his Air Force Specialty
(AFS) was 42370, rather than 4350.

APPLICANT CONTENDS THAT:
His records should reflect the more advanced skill-level, otherwise it may
raise questions when he applies for work in his career field.
In support of his request applicant provided copies of his DD Forms 214,

STATEMENT OF FACTS:
Applicant enlisted in the Regular Air Force on 5 Sep 61 and was
progressively promoted to the grade of staff sergeant, having assumed that
grade effective and with a date of rank of 1 Jun 68. He was discharged on
1 Dec 69 after serving 8 years, 2 months, and 27 days on active duty. His
AFS during his tenure was 43250, Aircraft Electrical Repairman. His DD
Form 214 issued on 1 Dec 69, which incorrectly reflects that his AFS is
4350, has been administratively corrected to reflect 43250.

AIR FORCE EVALUATION:
AFPC/DPPAC recommends denial of the applicant's request. A thorough review
of his records does not substantiate that his AFS number is in error. The
DPPAC evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 3 Jan
03 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. In this respect, evidence has not been
presented which would lead us to believe that the applicant's Air Force
Specialty Code (AFSC) as currently reflected on his DD Form 214 is
incorrect. After a thorough review of the evidence of record, we see no
evidence that the applicant completed the requirements for, or that he was
awarded the "7" skill level in his AFS. Accordingly, we agree with the
opinion and recommendation of the Air Force office of primary
responsibility and adopt their rationale as the basis for our conclusion
that the applicant has not been the victim of an error or injustice. In
the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

A Report of Individual Counseling dated 6 Nov 87 indicated the applicant had been advised he was being considered for discharge for failure to progress in the WMP. On 8 Feb 88, he was notified of his commander’s intent to recommend discharge for failure to progress in the WMP. A complete copy of the evaluation is at Exhibit C. HQ AFPC/DPPRS provide their rationale for recommend denial.

Subsequent to his name change and gender reassignment on 31 Jul 98, the applicant submitted an application to the Board requesting a DD Form 214 correction to reflect the name as J---- Marie W----. DPSAMP states that Air Force personnel records correctly reflects the applicant's name and gender during the period of service and on the date of retirement. In this case the DD Form 214 is correct as of the date of retirement.
