APPLICANT REQUESTS THAT:

His DD Form 214 be  corrected  to  show  his  Foreign  Service  during
Operation Desert Storm/Shield.

APPLICANT CONTENDS THAT:

He wanted to join the local VFW, but his DD  Form  214  could  not  be
excepted.

In support of his application, the applicant provided a  copy  of  his
discharge document.  The applicant’s submission, with  attachment,  is
at Exhibit A.

STATEMENT OF FACTS:

Applicant’s master personnel record (MPR) appears to have been lost or
destroyed.

Based on the available documentation the following facts are provided.

Applicant enlisted in the Regular Air Force on 12 March 1985.

On 6 September 1991, while serving in the grade of staff sergeant,  he
was released from active  duty  under  the  provisions  of  AFR  39-10
(Completed Extended Enlistment)  and  transferred  to  the  Air  Force
Reserve.

In a letter dated 9 August 2002, AFPC/DPAPP2 asked  the  applicant  to
make a thorough check of his personal files  to  see  if  he  had  any
documents pertaining to Operation Desert Storm  Shield.   He  provided
none.

AIR FORCE EVALUATION:

AFPC/DPAPP2 states that there are  no  documents  in  the  applicant’s
records that support his claim nor  verify  any  foreign  service.   A
complete copy of the evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 9 August 2002, a complete copy of  the  Air  Force  evaluation  was
forwarded to the applicant for review and response within 30 days.  As
of this date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Staff
and adopt their rationale as the basis for  our  conclusion  that  the
applicant  has  not  been  the  victim  of  an  error  or   injustice.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
