APPLICANT REQUESTS THAT:

She be considered for a Position Vacancy (PV) promotion.

APPLICANT CONTENDS THAT:

She was eligible and met all  the  requirements  for  the  U0403A  Promotion
board.  Her senior rater prepared a Promotion Recommendation form (PRF)  and
faxed it to the board.  However, the PRF did not make  it  into  her  record
and therefore, did not go before the board.

In support of her request applicant provided, a copy of her PRF,  fax  cover
sheets,  and  her  Officer  Performance  Reports   (OPRs).    Her   complete
submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Data extracted from the personnel data system reflects  that  the  applicant
was appointed a second lieutenant, Reserve of the Air Force on  18  May  93.
She was progressively promoted to the grade of captain, having assumed  that
grade effective and with a date of rank of 18 May 97.

AIR FORCE EVALUATION:

ARPC/DPB reviewed applicant's request and  recommends  denial.   DPB  states
that there is no record of receipt of either  fax  or  original  copy.   Her
attachments indicate both a fax and original were submitted on  30  Nov  01.
ARPC/SG and ARPC/DPBA both keep logs of receipt of PV  nominations  (SG  for
all health professions and DPBA for all nominations).  There may  have  been
intent on the part of the Executive  Officer  to  obtain  signature  of  the
senior rater and  submission  of  the  PRF,  but  it  did  not  happen.   No
nomination was ever received.  Submission of the original on  the  indicated
30 Nov 01 date would have been in sufficient time to process the  nomination
even if the fax copy had been misrouted or not sent.  The DPB evaluation  is
at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant responded to the Air Force evaluation and states that her PRF  was
signed by the senior rater and faxed by the executive officer on 30 Nov  01.
 In further support of  her  request  she  provided  a  statement  form  the
executive  officer  and  copies  of  documents  previously  submitted.   The
complete submission, with attachments, is at Exhibit D.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of error or  injustice.   In  this  respect,  in  support  of  her
appeal, the applicant provided a copy  of  her  signed  PRF  as  well  as  a
statement from her senior rater's Executive Officer in which he states  that
he faxed the PRF to the appropriate office on 30 Nov 01.  Having  no  reason
to doubt the Executive Officers integrity in this matter,  we  believe  that
every reasonable effort was made to ensure her PRF was  made  available  for
consideration by the selection board in question. Accordingly, we  recommend
that her records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT to include the attached Promotion Recommendation Form, AF  Form
709, signed by General Scott, be considered for promotion to  the  grade  of
major, Air Force Reserve, by a Special Review  Board,  and  her  records  be
evaluated in comparison with the records of officers who were and  were  not
selected by the Fiscal Year 2003 Reserve Major Position Vacancy  Board,  and
if recommended for promotion by the Special  Review  Board,  the  Air  Force
Board for Correction of Military Records be advised of  that  recommendation
at the earliest practicable date  so  that  all  necessary  and  appropriate
actions may be completed.

If she is not recommended for promotion by the  Special  Review  board,  the
office of primary responsibility advise her of  the  recommendation  of  the
Special Review Board.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to include the attached Promotion
Recommendation Form, AF Form 709, signed by General Scott, be considered
for promotion to the grade of major, Air Force Reserve, by a Special Review
Board, and her records be evaluated in comparison with the records of
officers who were and were not selected by the Fiscal Year 2003 Reserve
Major Position Vacancy Board, and if recommended for promotion by the
Special Review Board, the Air Force Board for Correction of Military
Records be advised of that recommendation at the earliest practicable date
so that all necessary and appropriate actions may be completed.

If she is not recommended for promotion by the Special Review board, the
office of primary responsibility advise her of the recommendation of the
Special Review Board.
