APPLICANT REQUESTS THAT:

She be considered for position vacancy (PV) promotion by  a  Special  Review
Board (SRB) for the Fiscal Year 2001B  (FY01B)  Reserve  of  the  Air  Force
(ResAF) Lieutenant Colonel PV Board.

THE APPLICANT CONTENDS THAT:

Due to administrative error, over which she had no  control,  her  Promotion
Recommendation Form (PRF) was pulled and  she  was  not  considered  for  PV
promotion by the FY01B board.

The applicant states that she was identified as eligible  for  PV  promotion
consideration by the FY01B board and recommended Performance  Recommendation
Form (PRF) inputs were submitted by the group  commander  and  forwarded  to
the wing commander.  However, an erroneous determination was made  that  she
was not in an eligible position number to be promoted.   As  a  result,  her
package was removed from consideration  before  being  reviewed.   In  March
2001, she called the  Air  Reserve  Personnel  Center  (ARPC)  to  check  on
eligibility requirements for the FY02 board and was  told  that  removal  of
her PRF package from PV consideration  was  in  error.   According,  to  the
PRISM list, AFI 36-2504,  and  the  available  Air  Force  Specialty  Code’s
(AFSC’s) with Position Vacancy  listing,  she  was  eligible  for  promotion
consideration.

In support of the appeal, applicant submits a  copy  of  her  PRF  that  was
prepared for the FY01B  board,  and  statements  from  the  wing  and  group
commanders and the senior rater.

STATEMENT OF FACTS:

The relevant facts  pertaining  to  this  application,  extracted  from  the
applicant's military records, are contained in the letter  prepared  by  the
appropriate office of the Air Force.   Accordingly,  there  is  no  need  to
recite these facts in this Record of Proceedings.

AIR FORCE EVALUATION:

ARPC/DPB reviewed this application and recommended denial.  They state  that
the  senior  rater  indicates  that  inaccurate  information  was  forwarded
stating that the applicant was not eligible for the board  and  her  package
was not submitted to ARPC.  However, the senior rater is not specific as  to
what inaccurate information cause him or any commander in her rating  chain,
to opt not  to  submit  a  nomination  package.   Furthermore,  ARPC/SG  has
established the  additional  requirement  that  all  nominees  complete  the
appropriate  level  of  Professional  Military  Education  (PME)  prior   to
submission of a nomination package.  This policy is  used  even-handedly  by
the  Health  Professions  Program  Manager   for   individual   mobilization
augmentees.  As this policy is not more  lenient  in  the  requirements  for
nomination, and more fully clarifies the  “outstanding  record”  requirement
in the Air Force Instruction (AFI), it is a logical and enforceable  policy.
 The issue of her occupying a higher graded position  could  not  have  been
the sole reason for non-submission of the nomination package.  Her  lack  of
the appropriate level  of  PME  was,  and  is,  a  strong  reason  for  non-
consideration.  She did not meet all the requirements for nomination.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:

The applicant reviewed the Air Force evaluation  and  states  that  had  her
name not been erroneously removed from consideration,  her  PRF  would  have
been signed and forwarded for PV promotion consideration.  However,  due  to
real world contingencies, her senior rater is unavailable to sign  a  letter
providing clarification of the inaccurate information in her  PV  nomination
package.  The promotion personnel at  the  305th  Mission  Support  Squadron
(305th MSS) erroneously removed her name from  the  consideration  following
the group commander’s endorsement and prior to the wing commander’s  review.
 Promotion personnel at ARPC erroneously informed 30th  MSS  personnel  that
she was not in an eligible position number for PV  promotion  consideration.
ARPC/SG centrally manages medical positions and their  memo  clearly  states
that she was eligible for PV promotion.  There is no doubt in her mind  that
communication between ARPC/SG, ARPC promotion  personnel,  and  McGuire  AFB
was lacking.  Her senior rater has endorsed  a  letter  indicating  that  he
would have signed her PRF had her package reached his desk and has  provided
a signed PRF.

In regards to the additional PME requirement, the applicant states that  the
policy was not in effect at the time of her promotion board and  she  should
not be evaluated against a higher standard than her peers meeting  the  same
board.  In this respect, she notes that  during  the  FY01B  board,  36%  of
those officers meeting the Nurse  Corps  Position  Vacancy  promotion  board
were promoted and had completed only Squadron Officer’s  School  (SOS).   As
such, ISS was obviously not a requirement for promotion consideration.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been  presented  to  demonstrate  the
existence of probable error or injustice warranting promotion  consideration
to the Reserve grade of lieutenant colonel by Special Review  Board.   After
reviewing the  evidence  of  record,  it  appears  that  the  applicant  was
misinformed that she was ineligible for  promotion  and  as  a  result,  her
Promotion Recommendation Form (PRF) was pulled before being reviewed by  the
Fiscal Year 2001  (FY01)  Air  Force  Reserve  Lieutenant  Colonel  Position
Vacancy Selection Board.  In this respect, we note that the  requirement  to
have completed Intermediate Service School (ISS) was not in effect when  the
FY01 selection board convened.  In view of the  above  findings  and  in  an
effort  to  offset  any  possibility  of  an  injustice,  we  recommend  the
applicant’s records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT, to include the  attached  Promotion  Recommendation  Form,  AF
Form 709, be considered for promotion to the  Reserve  grade  of  lieutenant
colonel by a Special Review Board (SRB); that her  record  be  evaluated  in
comparison with the records of officers who were and were  not  selected  by
the Fiscal Year 2001 Air Force Reserve Lieutenant Colonel  Position  Vacancy
Selection Board; and, if she is recommended for promotion by Special  Review
Board, the Air Force Board for Correction of Military Records be advised  of
that recommendation at the earliest practicable date, so that all  necessary
and appropriate actions may be completed.

If she is not recommended for promotion by the  Special  Review  Board,  the
Office of primary responsibility advise her of  the  recommendation  of  the
Special Review Board.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to APPLICANT, to include the attached Promotion
Recommendation Form, AF Form 709, be considered for promotion to the
Reserve grade of lieutenant colonel by a Special Review Board (SRB);
that her record be evaluated in comparison with the records of
officers who were and were not selected by the Fiscal Year 2001 Air
Force Reserve Lieutenant Colonel Position Vacancy Selection Board;
and, if she is recommended for promotion by Special Review Board, the
Air Force Board for Correction of Military Records be advised of that
recommendation at the earliest practicable date, so that all necessary
and appropriate actions may be completed.

      If she is not recommended for promotion by the Special Review
Board, the Office of Primary Responsibility advise her of the
recommendation of the Special Review Board.
