APPLICANT REQUESTS THAT:

She receive supplemental promotion consideration for the  Fiscal  Year  2005
(FY05) Line and Health Professions Lieutenant Colonel Position Vacancy  (PV)
Promotion Selection Board.

THE APPLICANT CONTENDS THAT:

Although her senior rater submitted a Promotion Recommendation  Form  (PRF),
AF Form 709, to the Air Reserve Personnel  Center  (ARPC)  recommending  her
promotion, she was not considered for promotion.

In  support  of  the  appeal,  applicant  submits  a  statement   from   the
Noncommissioned Officer-in-Charge (NCOIC), Promotions and  Testing,  of  her
Military Personnel Flight (MPF);  a  records  transmittal,  dated  21  April
2004; the Federal Express routing slip and tracking  results,  and  the  PRF
prepared for the FY05 board.

The NCOIC, Promotions and Testing, states, in part, that applicant  was  one
of five individuals who had their PRFs transmitted to ARPC on 21 April  2004
for the FY05 board.  While two of the five  individuals  were  selected  for
promotion, the applicant and two other individuals were not  considered  for
promotion because their PRFs were not received by ARPC.

STATEMENT OF FACTS:

Applicant is serving in the Air Force Reserve in the grade of major.

A Records Transmittal/Request, dated 21 April 2004, indicates that  on  that
date, a PRF prepared on the  applicant  for  the  FY05  board  was  sent  to
ARPC/DPBA, Denver, Colorado.  A Federal Express tracker  indicates  the  PRF
was received in Denver, Colorado on 22 April 2004.

The Fiscal Year 2005 (FY05) Line and Health Professions  Lieutenant  Colonel
Position  Vacancy  Promotion  Selection  Board  convened  at  ARPC,  Denver,
Colorado, on 14 June 2004.   The  FY05  board  did  not  consider  applicant
because her PRF had not been received by ARPC/DPB.

AIR FORCE EVALUATION:

ARPC/DPB recommends the application be denied  and  states,  in  part,  that
applicant  could  not  have  met  the  promotion  board  because  his  (sic)
nomination (AF  Form  709)  was  not  received  by  ARPC/DPB  prior  to  the
convening of the selection board.

The ARPC/DPB evaluation is at Exhibit B.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:

Her organization and leadership did everything in their power to ensure  her
records met the board.  Her package was sent via  Federal  Express  and  was
received in Denver on 22 April 2004, along with other packages in  a  single
parcel.  Mysteriously, her PRF and two  others  were  not  provided  to  the
board.  An administrative mistake occurred in Denver for which she is  being
penalized.  She is currently functioning in a  lieutenant  colonel  position
because her leadership has the  faith  and  trust  that  she  can  and  will
execute the duties as a more senior officer.  Her records are  superior  and
she has never missed a day of duty.  She has earned the right  to  meet  the
board and should not have her reserve career destroyed by an  administrative
error made by someone other than herself.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of error or injustice.  In this respect, we note that  almost  two
months prior to the FY05 board  convening,  applicant’s  servicing  Military
Personnel Flight (MPF) forwarded her PRF, along with the PRFs of four  other
eligible officers, to ARPC via Federal Express  (FedEx).   A  FedEx  routing
slip indicates  the  package  was  received  in  Denver  on  22 April  2004;
however, ARPC/DPB indicates they never received  applicant’s  PRF  prior  to
the convening of the FY05 board.  We find this incredulous in  view  of  the
indisputable evidence substantiating the package was received at ARPC  prior
to  the  board  convening,  and  considering  that  two  of  the  five  PRFs
transmitted to ARPC in the same package were received by ARPC/DPB.  In  view
of this, we recommend the applicant’s records be  corrected  to  the  extent
indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to  APPLICANT  be  corrected   to   show   that   the   attached   Promotion
Recommendation Form (PRF), AF Form 709, prepared for the  Fiscal  Year  2005
(FY05) Line and Health Professions Lieutenant Colonel Position Vacancy  (PV)
Promotion Selection Board, was accepted for file on 22 April 2004.

It  is  further  recommended  that  her  record,  to  include  the  attached
Promotion Recommendation Form, AF Form 709,  signed  by  Colonel  Close,  be
considered for promotion to the  grade  of  lieutenant  colonel,  Air  Force
Reserve, by a Special Review Board (SRB), and her records  be  evaluated  in
comparison with the records of officers who were and were  not  selected  by
the FY05  Line  and  Health  Professions  Lieutenant  Colonel  PV  Promotion
Selection Board, and if recommended for promotion by the SRB, the Air  Force
Board for Correction of Military Records be advised of  that  recommendation
at the earliest practicable date  so  that  all  necessary  and  appropriate
actions may be completed.

If she is not recommended for promotion by the SRB, the  office  of  primary
responsibility advise her accordingly.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to XXXXX, be corrected to show that the attached Promotion
Recommendation Form (PRF), AF Form 709, prepared for the Fiscal Year 2005
(FY05) Line and Health Professions Lieutenant Colonel Position Vacancy (PV)
Promotion Selection Board, was accepted for file on 22 April 2004.

      It is further directed that her record, to include the attached
Promotion Recommendation Form, AF Form 709, signed by Colonel Close, be
considered for promotion to the grade of lieutenant colonel, Air Force
Reserve, by a Special Review Board (SRB), and her records be evaluated in
