APPLICANT REQUESTS THAT:
His records, to include the Officer Performance Report (OPR) rendered for
the period 21 February 2000 through 2 August 2000, be considered for
promotion to the grade of colonel by a Special Selection Board (SSB) for
the Calendar Year 2001A (CY01A) Central Colonel Medical Service Corps (MSC)
Selection Board.

APPLICANT CONTENDS THAT:
The absence of his most recent OPR from the promotion recommendation and
promotion selection processes, placed his promotion record at a
disadvantage.
The applicant states that due to administrative errors the contested report
was not in his records at the time his PRF was prepared and at the time he
was considered for promotion by the CY01A Board.
In support of the appeal, applicant submits a copy of the contested report,
the PRF prepared for the CY01A Board, and his personal statement.

STATEMENT OF FACTS:
The applicant was considered and not selected for promotion to the grade of
colonel by the CY 98A, CY98B, CY99B, and CY01A Boards.

AIR FORCE EVALUATIONS:
AFPC/DPPPE states, in part, that the contested OPR should have been
completed before the Management Level Review (MLR) and was not. However,
without a request for inclusion of a replacement PRF, along with supporting
documentation from the senior rater and MLR president, they cannot
recommend any remedy concerning the original MLR/PRF process.
The AFPC/DPPPE evaluation, with attachments, is at Exhibit C.
AFPC/DPPPA recommends disapproval of the applicant’s request for SSB
consideration with the OPR a matter of record. AFPC/DPPPA states, in part,
that with supporting documentation from either his evaluators or someone in
the administrative process to explain the delay in writing, signing, and
filing the report, they might justify approving SSB consideration; however,
the applicant provides no such evidence.

APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS:
Complete copies of the Air Force evaluations were forwarded to the
applicant on 2 November 2001, for review and response. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. In this respect, we note that
the contested OPR, closing 2 August 2000, should have been in the
applicant’s officer selection record when he was considered for promotion
to the grade of colonel by the CY01A selection board, which convened on 8
January 2001. Since the report was not timely filed in his records through
no fault of the applicant, we recommend that he applicant be considered for
promotion to the grade of colonel by SSB for the CY01A board.
4. As noted by the Air Force evaluation, applicant’s Promotion
Recommendation Form (PRF) for the CY01A was accomplished without
consideration of the contested OPR. Therefore, if he desires to have his
PRF corrected, he is encouraged to submit an appeal to the Evaluation
Reports Appeal Board (ERAB).

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that the Field Grade Officer Performance
Report (OPR), AF Form 707A, rendered for the period 21 February 2000
through 2 August 2000, be amended to reflect that the rater, additional
rater, and reviewer signed the report on 20 September 2000.
It is further recommended that his record, to include the OPR rendered for
the period 21 February 2000 through 2 August 2000, be considered for
promotion to the grade of colonel by a Special Selection Board for the
Calendar Year 2001A Central Colonel Medical Service Corps Selection Board.

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the Field Grade Officer
Performance Report (OPR), AF Form 707A, rendered for the period 21 February
2000 through 2 August 2000, be, and hereby is, amended to reflect that the
rater, additional rater, and reviewer signed the report on 20 September
2000.
It is further directed that his record, to include the OPR rendered
