APPLICANT REQUESTS THAT:
The Armed Forces Expeditionary Medal, the NATO/UN Medal and the new
Kuwait Liberation Medal be included in his record.
APPLICANT CONTENDS THAT:
He was processing for placement on the Temporary Disability Retired
List (TDRL) when he believes these medals were in the process of
being issued. He was later placed on the Permanent Disability
Retired List (PDRL) and believes his record may require an
adjustment.
Applicant provided copies of his DD Form 214 and orders for
Operations Desert Storm, Provide Promise, and Provide Comfort
(Exhibit A).
STATEMENT OF FACTS:
Applicant entered on active duty on 18 August 1981. He was
promoted to the grade of E-5, effective 1 February 1990. He was
honorably released from active duty on 12 July 1996, and his name
was placed on the TDRL. He had served 14 years, 10 months and
25 days on active duty. Effective 7 January 1998, Applicant’s name
was removed from the TDRL and he was permanently retired in the
grade of E-5 with a compensable disability rating of 50%.
Applicant’s DD Form 214, Certificate of Release or Discharge from
Active Duty, shows that he served in support of Desert Shield/Storm
from 2 August 1990 - 12 July 1996.
Special Order TC-0103 indicates Applicant was to proceed on or
about 4 August 1993 for a period of 179 days in support of
Operation Provide Comfort.
Special Order TE-0393 indicates Applicant was to proceed on or
about 24 August 1994 for a period of 179 days in support of
Operation Provide Promise.
Special Order TE-0805 indicates Applicant was to proceed on or
about 24 June 1995 for a period of 91 days to participate in
Operation Desert Storm.
The Air Force Commendation Medal, First Oak Leaf Cluster, awarded
to Applicant for meritorious service for the period 20 October 1992
to 2 May 1995, indicates he was deployed in support of Operations
Provide Comfort and Deny Flight.
On 2 July 1999, Applicant’s DD Form 214 was corrected by deleting
the Armed Forces Medal with 1 device and adding the Armed Forces
Service Medal with 1 Bronze Service Star.
AIR FORCE EVALUATION:
The Recognition Programs Branch, AFPC/DPPPR, reviewed this
application and recommended disapproval. The Applicant did not
respond to their 8 April 1999 request to provide copies of his
Travel Vouchers or other documents to substantiate his claims.
Without the requested documentation to show the country to which he
was TDY and the inclusive dates he was in that country, DPPPR
cannot verify his eligibility for additional awards. TDY orders
alone are not sufficient documentation. DPPPR’s complete
evaluation, with attachments, is at Exhibit C.
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 26 July 1999, for review and comment within 30 days (Exhibit D).
As of this date, no response has been received by this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of probable error or injustice. We noted
the applicant's complete submission in judging the merits of the
case; however, these documents, by themselves, do not substantiate
his entitlement to these awards. Therefore, we agree with the
opinion and recommendation of the Recognition Programs Branch and
adopt their rationale as the basis for our conclusion that, unless
the applicant submits evidence that establishes his eligibility for
the requested decorations; i.e., copies of travel vouchers for each
trip, we find no compelling basis to recommend granting the relief
sought in this application.
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission
of newly discovered relevant evidence not considered with this
application.
