APPLICANT REQUESTS:

Award of the Southwest Asia Service Medal and any other  medals  not
listed on his DD Form 214 (Certificate of Release or Discharge  From
Active Duty).

APPLICANT CONTENDS THAT:

He served in the military during the Gulf War and also was  over  in
Saudi Arabia.  He deserves the same rights as all other veterans  of
the Gulf War.

Applicant’s complete submission is attached at Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force (RegAF) on 31 Mar 88
for a period of four years in the grade of airman basic.

Applicant’s DD Form 214 reflects award of the Air Force Good Conduct
Medal (AFGCM), National Defense Service Medal (NDSM),  and  the  Air
Force Training Ribbon (AFTR).

Applicant’s Enlisted  Performance  Report  (EPR)  rendered  for  the
period 30 Nov 89 through 29 Nov 90  mentions  three  temporary  duty
(TDY) trips:  (1)  15-19 Apr 90 to California  in  support  of  SAAM
3472; (2)  May-Sep 90 to Honduras, in support of  Joint  Task  Force
Bravo; and (3)  15 Sep-30 Oct 90 to xxxxxxx  XXXXX  AAF,  Texas,  in
support of Operation Desert Shield.

On 10 Dec 92, the applicant was released from active duty under  the
provisions of AFR 39-10 (Voluntary-Miscellaneous  Reasons)  with  an
honorable characterization of service in the grade of senior airman.
 He was credited with 3 years, 8  months,  and  10  days  of  active
service.

On 13 Apr 99, the Chief, Awards & Decorations  Section,  AFPC/DPPPR,
requested the applicant provide a copy  of  his  Travel  Voucher  in
order to verify the location and  inclusive  dates  of  his  TDY  in
support of Operation Desert Shield.   These  dates  were  needed  to
determine exactly  which  additional  awards  he  was  entitled  to.
However, the applicant did not respond to this request.

On 21 Jul 99, a DD Form 215 (Correction to DD Form 214,  Certificate
of  Release  or  Discharge  From  Active  Duty)   was   accomplished
reflecting award of the Air Force Achievement Medal (AFAM).

AIR FORCE EVALUATION:

The Chief, Awards & Decorations Section, AFPC/DPPPR,  reviewed  this
application and indicated that without a copy of the Travel Voucher,
they cannot verify that the applicant was in the Persian  Gulf  Area
of Responsibility for 30  consecutive  or  60  nonconsecutive  days;
therefore, they cannot verify his eligibility for the Southwest Asia
Service Medal or either Kuwait Liberation Medal.  The applicant  was
requested to furnish a copy of his Travel Voucher and he  was  given
the address from which it could be obtained if he  did  not  have  a
copy; he did not respond to this request.  In view of  his  previous
TDY to XXXXX XXXXX AAF, Texas, in support of Operation Desert Shield
and no documentation to support his  claim  that  he  was  in  Saudi
Arabia, DPPPR cannot verify his claim  that  he  was  TDY  to  Saudi
Arabia; therefore, they recommend  disapproval  of  the  applicant’s
request for award of the Southwest Asia Service Medal.

A  complete  copy  of  the  Air  Force  evaluation  is  attached  at
Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant reviewed the Air Force evaluation and provided a  copy  of
his Travel Voucher.

Applicant’s complete response,  with  attachments,  is  attached  at
Exhibit E.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by  existing
law or regulations.

2.    The application was not timely filed; however, it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice.  While  it  cannot  be
conclusively determined  from  the  illegible  copy  of  applicant’s
travel  voucher  whether  he  was  in  the  Persian  Gulf  Area   of
Responsibility for 30 consecutive or 60 nonconsecutive  days,  after
noting his EPR closing 29 Nov 90 which indicated he was deployed  to
XXXXX XXXXX in support of Operation Desert Shield, we  believe  that
in order to offset any possibility of an injustice to the applicant,
any doubt should be resolved in his favor.  Therefore, we  recommend
his records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of  the  Air  Force
relating to APPLICANT, be corrected to show that he was awarded  the
Southwest Asia Service Medal in support of Operation  Desert  Shield
for the period 15 Sep - 30 Oct 90.

Executive Session on 18 April 2000, under the provisions of AFI  36-
2603:

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of  the  Air
Force Board  for  Correction  of  Military  Records  and  under  the
authority of Section 1552, Title 10, United States  Code  (70A  Stat
116), it is directed that:

      The pertinent military records of the Department  of  the  Air
Force relating to, be corrected to show that be  corrected  to  show
that he was awarded the Southwest Asia Service Medal in  support  of
Operation Desert Shield for  the  period  15 September -  30 October
1990.
