RESUME OF CASE:
In an application dated 7 July 1998, applicant requested his date of
rank (DOR) to lieutenant colonel (LTC) be changed from 23 January 1998
to 30 October 1997.
On 6 April 1999, the Board considered and denied applicant's request.
However, the Board added that it would be willing to reconsider the
case should the applicant provide documentation indicating his
supervisors made every reasonable effort to ensure his promotion would
be processed in time to have an effective DOR of 30 October 1997. A
complete copy of the Record of Proceedings is attached at Exhibit D.
In a letter dated 20 July 1999, applicant requests reconsideration in
light of the supporting statement from the Reserve Advisor to DCS
Operations, HQ USAF/XO-ARC. The Advisor asserts the fax requesting
accelerated promotion with a 30 October 1997 DOR went forward on 20
October 1997; however, the request must have been inadvertently
mishandled at ARPC.

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. Based on the Reserve
Advisor’s supporting statement, it appears that the request for his
accelerated promotion to LTC was faxed to ARPC in sufficient time to
be processed for the 30 October 1997 DOR. The unaccountable delay
appears to have occurred at ARPC. In the interest of justice, we
believe any doubt in this case should be resolved in the applicant’s
behavior. Therefore, we recommend his DOR to LTC be changed to that
intended by HQ FAA/AAT4---30 October 1997.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that his promotion to the
Reserve grade of lieutenant colonel was effective and with a date of
rank of 30 October 1997, rather than 23 January 1998.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to xxxxxxxxxxxxxxxxxxxxxxxxx, be corrected to show that
his promotion to the Reserve grade of lieutenant colonel was effective
and with a date of rank of 30 October 1997, rather than 23 January
1998.
