RESUME OF CASE:
On 10 September 1998, the Board considered applicant's request
that his reenlistment date be changed from 1 5 January 1998 to
20 January 1998. The Board found insufficient evidence of a
probable error or an injustice and denied the application. A
copy of the Record of Proceedings is attached at Exhibit E.
THE BOAR D CONCLUDES THAT :
Sufficient relevant evidence has been presented to demonstrate
the existence of a probable error or injustice. The applicant
contends that he was miscounseled regarding his reenlistment date
and entitlement to a Se1.ective Reenlistment Bonus (SRB) . Although
a statement from the individual that miscounseled the applicant
would be helpful in deciding this case, we believe it is apparent
the applicant was miscounseled. Prior to his reenlistment, the
applicant requested that his reenlistment date be changed to
ensure his entitlement to an SRB. The applicant's Career Job
Reservation (CJR) had not expired and his reenlistment date could
have been changed. However, through no fault of the applicant no
action was taken to change his reenlistment date, and as a
result, he was allowed to reenlist only days prior to becoming
eligible for an SRB. In view of this, we believe it would be
unjust to deny his request solely on the absence of a statement
from the individual that miscounseled the applicant. Therefore,
we recommend his records be corrected to the extent indicated
below.
THE BOARD R ECOMMENDS THAT :
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he was honorably
discharged on 24 January 1998, rather than 4 January 1998, and
reenlisted in the Regular Air Force on 2 5 January 1998, rather
than 5 January 1998, for a period of six ( 6 ) years with
entitlement to a Zone A, Multiple one-half, Selective
Reenlistment Bonus.
