APPLICANT REOUESTS THAT:
His records be corrected to show he was promoted to the Reserve
grade of captain, with a promotion effective date (PED) and a
promotion service date (PSD) of 11 August 1 9 9 5 .
RESUME OF THE 'CASE:
The applicant is an active Reserve officer serving in the grade of
captain, with a PSD and PED of 8 August 1 9 9 6 .
In an application dated 2 0 August 1995, the applicant requested he
receive point credits for service he performed but was deprived of
when it was discovered he was not assigned to a funded billet. He
also requested he be awarded sufficient points for three additional
years of satisfactory Federal service and promotion to the grade of
captain on 11 August 1 9 9 5 .
His requests were considered by the
Board on 1 2 November 1 9 9 6 . After reviewing the evidence, the Board
determined that the applicant's records should be corrected to
entitle him to a satisfactory year of Federal service for the
Retirement Year Ending (RYE) 2 4 September 1994 and restore his
eligibility for consideration for promotion by the FY 1 9 9 6 Air
Force Reserve Captain Unit Vacancy Selection Board. The Board also
recommended that his records be considered by a Special Review
Board (SRB) for promotion by the FY 1 9 9 6 selection board. The
Board denied his requests for a direct promotion to captain with a
PSD and PED of 11 August 1 9 9 5 and satisfactory years of Federal
service for the RYES 1991, 1992 and 1993 (see AFBCMR 9 5 - 0 2 9 6 3 , with
Exhibits A through F).
AIR FORCE EVALUATION:
The Promotion Secretariat Division, AFPC/DPJB, provided the results
of the SRB held during the week of 9-13 June 1997 in conjunction
with the FY 1 9 9 8 Reserve of the Air Force Line and Health
Professions Lieutenant Colonel Selection Board. In the opinion of
the majority of the voting members, the applicant should not have
been recommended for promotion by the FY 1996 Air Force Reserve

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the SRB's recommendation was forwarded to the applicant
on 9 July 1997 for review and comment. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
As a result of our previous consideration of this application, the
applicant's records were corrected to show he was placed in an
active Reserve position on 5 May 1994 and he was awarded credit for
a satisfactory year of Federal service for the Retirement Year
Ending (RYE) 25 September 1994. In addition, it was directed that
his record be considered by an SRB for promotion by the FY 1996
Reserve of the Air Force Captain Unit Vacancy Selection Board. The
SRB has been conducted as directed and we concur with their
recommendation. The consideration of the applicant's record by the
SRB allowed for a comparison with his contemporaries and assisted
in the determination as to any possible inequity which may have
resulted from the inaccurate record. Since it is the opinion of
the SRB that the applicant would not have been recommended for
promotion by the subject selection board had he been a consideree,
and in the absence of any evidence by the applicant which would
lead us to believe the contrary, we have no basis to favorably
consider his request for a direct promotion by this Board.
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission
of newly discovered relevant evidence not considered with this
application.
