This is in reference to your application for correction of your naval record pursuant to the provisions of 0 USC 1552.

A three-member panel of the Board for Correction of Naval Records, sittin g in executive session, consider ed your application on 29 March 2007. Your allegations of e r ror and injustice were reviewed in acc ordance with administrative regu lations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of our application, together with all material submitted in support the r eof, your naval record and applicable statutes, regulations and p olicies. In addition, the Board considered the advisory opinion furni s hed by CNO memo 7220 N13OD1/06U0663 of 10 Nov 06, a copy o which is attached.

After careful and conscientious consi d eration of the entire record, a majority of the Board found that the e vidence submitted was insufficient to establish the existen c e of probable material error or injustice. In this connection, the B o ard substantially concurred with the comments contained in the advisor opinion. Accordingly, your application has been denied. The nam e s and votes of the members of the panel will be furnished upon requ e st.

It is regretted that the circumstance of your case are such that favorable action cannot be taken. Yo u are entitled to have the Board reconsider its decision upon submissi o n of new and material evidence or other matter not previously consid e red by the Board. In this regard, it is also important to keep n mind that a presumption of regularity attaches to all official r cords. Consequently, when applying for a correction of an off ic al naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
