1. Pursuant to the provi\ions of reference (a), Subject lictreinafter referred to a \ Petitioner,

2. The Roartl, consisting of Messrs. McHritle, McPartlin, and Ms. McCormick. reviewed
Petitioner's allegations of error and inJ~lstice on 21 May 2002 antl, pilrsuant to its regulations,
deterlninetl that tlie corrective action indicated below sho~~lcl he taken on the available
evidence of record. Doc~r~nentary ~iiaterial considered by tlie Boartl consisted of tlie
enclosures, naval records, antl applical,lct statutes, regulations and policies.
3. The Board, having reviewed all tlie facts of record pertaining ti) Petitioner's allegations
of error and injustice, tintls as follows:
a. Before applying to this Board, Petitioner exhausted all administrative remedies
available under existing law and regu1;itions within tlie Department of the Navy.
b.
In correslxmtlence attached as enclosure (2), the office liav~ng cognizance over the
subject matter atltlressed in Petitioner's application has cornlnented to tlie effect tliat the
request has merit and warrants hvorahle action.
IJpon review and consideration of all the evidence of record, and especially i n light of the
contents of enclosure (2), the Roarcl finds the existence of an i l ~ i 11 stice warranting the
following corrective action.

RECOMMENDATION:
That Petitioner's naval record he corrected, wlieie appropriate, to show atlvancetiient to tlie
rate/grade of AL)2/E5 effective effective 3 1 October 200 1 .
a. That a copy of this Report of I'roceetlings be filed in Petitioner's naval record.
4. Pursuant to Section 6(c) of tlie revised Procedures of the Board for Correction of Naval
