      The Army Discharge Review Board reviewed your case and determined
that relief is warranted.  The Board has directed the ARBA Support
Division, St. Louis, MO, to take action as indicated on the enclosed OSA
Form 172, Case Report and Directive.  This document reflects the findings,
conclusions, and reasons for the Board's decision.  The official
notification of any change to your official military personnel record,
including the appropriate documentation, will be mailed to you by the ARBA
Support Division.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that directive.  You should
read Enclosure 5 of that directive before submitting a complaint.  The
complaint procedure does not permit you to challenge the merits of the
decision, but is designed solely to ensure that the decisional document
meets applicable requirements for clarity and responsiveness.  You may

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 31 October 1997, the applicant
was found guilty by a Special Court-Martial of wrongfully using cocaine.
She was sentenced to be discharged with a Bad Conduct Discharge and
reduction to E1.  On 12 January 1998, the applicant was placed on excess
leave pending the affirmation and execution of the Bad Conduct Discharge.
On 6 January 1998, the sentence was approved.  The record of trial was
forwarded to The Judge Advocate General of The Army for review by the Court
of Military Review.  The remaining findings of guilty and the sentence to
reduction to E1 and a bad conduct discharge were affirmed.  On 8 August
2002, the portion of the sentence pertaining to the Bad Conduct Discharge
was affirmed by the Court of Military Review pursuant to Article 71c, and
was ordered executed.

      b.  On 13 November 2002, the applicant was discharged.  At the time
of discharge, the applicant had completed 5 years and 12 days of active
military service (to include 1767 days of excess leave) in the period under
review and had a total of 16 years and 9 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 3, Section IV, establishes policy and procedures for separating
members with a dishonorable or bad conduct discharge; and provides that a
soldier will be given a bad conduct discharge pursuant only to an approved
sentence of a general or special court-martial; and that the appellate
review must be completed and the affirmed sentence ordered duly executed.

        (1)  The issue is rejected.  The evidence of record clearly shows
that the applicant was adjudged guilty by court-martial for wrongfully
using cocaine and that the sentence was approved by the convening
authority.  The Board determined that the applicant’s misconduct diminished
the quality of her service below that meriting a fully honorable discharge.

       (2)  The issue is accepted.  The Board carefully reviewed the
applicant’s military record and post service accomplishments and found that
clemency was warranted.  Accordingly, the Board voted to upgrade the
applicant’s characterization of service to general, under honorable
conditions.  A change in the reason for discharge is not authorized under
Federal statute.
