      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable
requirements for clarity and responsiveness.  You may obtain a copy of DoD

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.  Evidence
of record shows that on 29 June 2001, the unit commander recommended that
the applicant be discharged from the Army Reserve under the provisions of
Chapter 12, AR 135-178, by reason of misconduct with an honorable
discharge.  On 7 June 2002, DA, HQ, 98th Division (Institutional Training),
Rochester, New York, Orders 158-013 discharged the applicant from the Army
Reserve, effective 7 June 2002.  His service was characterized as
honorable.

      b.  On 7 June 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 10 months, and 10 days of
military service in the period under review and had a total of 27 years, 7
months and 1 day of active military service.  (Total military service
calculation does not denote qualifying years for retirement.)

      c.  The applicant submitted a statement with his application
indicating that he tested positive on a unit urinalysis for illegal use of
drugs.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 135-178
(Separation of Enlisted Personnel) provides for the separation of enlisted
personnel of the Army Reserve and Army National Guard.  Chapter 12 of this
regulation defines misconduct by reason of one or more of the following:
minor disciplinary infractions, a pattern of misconduct, commission of a
serious offense (to include abuse of illegal drugs,) and conviction by
civil authorities.  The service of a soldier discharged for reasons
indicated in paragraph 7, will normally be characterized as under other
than honorable conditions.  If warranted by the soldiers overall record, a
characterization of service of under honorable conditions may be furnished.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
available record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board noted the applicant’s contentions;
however, did not find said contentions sufficiently mitigating to warrant a
change in his reason for discharge.  Further, the Board found that the
applicant’s use of illegal drugs properly formed the basis for his
discharge.  The applicant, by violating the Army's policy not to abuse
illegal drugs compromised the special trust and confidence placed in a
senior non-commissioned officer (NCO).  The applicant, as a senior NCO, had
the duty to support and abide by the Army's drug abuse policies.  By his
actions, the applicant knowingly risked a military career and fully
understood the possible repercussions of his actions.  The applicant’s
request pertaining to retirement and/or re-instatement do not fall within
the purview of this Board.  If the applicant desires to pursue these
matters he should address them to the Army Board for Correction of Military
Records using the provided application.  The Board, being convinced that
the reason for discharge was both proper and equitable, voted to deny
relief.
