SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records. Evidence
of record shows that on 18 June 2003, DA, HQ, 77th Regional Support
Command, Fort Totten, Flushing, New York, Orders 03-169-00027, discharged
the applicant from the United States Army Reserve, effective date 18 June
2003, with a characterization of service of general, under honorable
conditions.
b. On 18 June 2003, the applicant was discharged. At the time of
discharge, the applicant had completed 5 years, 3 months, and 28 days of
military service in the period under review and had a total of 24 years, 10
months, and 23 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 135-178
provides for the separation of members of the Army National Guard and Army
Reserve when it is determined that a service member is unqualified for
further military service.

(1) The issue is rejected. The applicant’s record is void of
facts and circumstances concerning events that led to a discharge from the
Army Reserve. The Board noted that the applicant’s record contains a
properly constituted discharge order indicating that he was discharged from
the Army Reserve under the provisions of AR 135-178, with a general, under
honorable conditions discharge. The applicant provided no independent
corroborating evidence demonstrating that either the command’s action was
erroneous or that the applicant’s service mitigated the misconduct or poor
duty performance. In the absence of any evidence to the contrary, the
Board presumed government regularity in the discharge process. The Board,
being convinced that the reason for discharge and the characterization of
service were both proper and equitable, voted to deny relief.
