PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 22 October 1997, the unit commander notified the applicant of 2 unexcused absences for assemblies 1 and 2. She was advised of her rights. On 9 December 1997, Orders 343-50 DA 88
th Regional Support Command; 506 Roeder Circle Fort Snelling, Minnesota; discharged the applicant form the US Army Reserve with an uncharacterized discharge, under the provisions of Chapter 11 N1, AR 135-178.

         b. On 10 December 1997, the applicant was discharged with an uncharacterized discharge. At the time of discharge, the applicant had 3 years service on her current enlistment and 7 years, 6 months and 1 day, total time in service.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 135-178, establishes policies, standards, and procedures governing the administrative separation of enlisted soldiers from the Army National Guard of the United States (ARNGUS) and the United States Army Reserves (USAR). Chapter 11 prescribes the policies and procedures for the separation of enlisted soldier at the expiration term of service. A soldier being discharged on the expiration of enlistment, reenlistment, or fulfillment of service obligation will be awarded a characterization of service of honorable unless the soldier is in an entry-level status. The service of soldiers in an entry-level status will be uncharacterized unless being discharged for misconduct.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The evidence of record indicates that the applicant was discharged under the provisions of Chapter 11, AR 135-178, by reason of expiration of term of service with an uncharacterized discharge. In accordance with Chapter 11, AR 135-178, soldiers discharged at the expiration of term of service will be awarded a characterization of service of honorable unless the soldier is in an entry-level status. At the time of discharge the applicant was not in an entry-level status and had completed her 3-year period of enlistment. Therefore, her uncharacterized discharge is improper. Accordingly, the Board voted to grant relief in the form of a fully honorable discharge. The Board noted the reason for discharge was proper and equitable and voted not to change it.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
