      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 16 January 2003, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter 7, AR 635-200, by reason of fraudulent entry,
with service uncharacterized.  The unit commander indicated that he was
initiating separation proceedings because the applicant wrongfully
concealed information regarding his medical history at the time of
enlistment.  He was advised of his rights.  The applicant waived his right
to consult with legal counsel, was advised of the impact of the discharge
action, and did not submit a statement in his own behalf.  The unit
commander subsequently recommended separation from the service and waiver
of further rehabilitative efforts.  The intermediate commander reviewed the
proposed discharge action and recommended approval of the separation action
with an uncharacterized.  On 28 January 2003, the separation authority
waived further rehabilitative efforts and directed that the applicant be
discharged with an uncharacterized discharge.

      b.  On 30 January 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 5 months and 17 days of active
military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 7, paragraph 7-17, of that regulation provides, in pertinent part,
that a fraudulent entry is the procurement of an enlistment, reenlistment,
or period of active service through any deliberate material
misrepresentation, omission, or concealment of information which, if known
and considered by the Army at the time of enlistment or reenlistment, might
have resulted in rejection.  This includes all disqualifying information
requiring a waiver.  A soldier who concealed his or her conviction by civil
court of a felonious offense normally will not be considered for retention.
 Soldiers separated under this chapter may be awarded an honorable
discharge, or a general discharge, or a discharge under other than
honorable conditions.  If in an entry level status the characterization
will be uncharacterized.

                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 The evidence of record shows that the applicant was separated under the
provisions of AR 635-200, Chapter 7, for fraudulent entry for wrongfully
concealing information about his medical history at the time of enlistment.
 The applicant’s service was uncharacterized because he was in entry-level
status, i.e., in an initial probationary period of service.  Any individual
who has served for less than l80 days at the time his or her commander
initiated separation action, and is not being separated for serious
misconduct, will be given an uncharacterized discharge.  An uncharacterized
discharge denotes only that the individual had less than l80 days on active
duty.  A fully honorable discharge may be granted only in cases which are
clearly warranted by unusual circumstances involving outstanding personal
conduct and/or performance of duty.  In the absence of any evidence to the
contrary, the Board determined that no such unusual circumstances were
present in the applicant’s record and his service did not warrant an
honorable discharge.  The applicant's discharge was appropriate because his
dishonesty was not consistent with the Army's standards for military
personnel and because he fraudulently obtained benefits to which he was not
entitled.  The Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.
