PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 26 December 1991, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 7, AR 635-200 by reason of fraudulent entry, with a general, under honorable conditions discharge. He was advised of his rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval with a general, under honorable conditions discharge. On 8 January 1992, the separation authority directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 16 January 1992, the applicant was discharged. At the time of discharge the applicant had 2 years, 2 months, and 23 days, active service on his current enlistment under review.

         c. The unit commander recommended separation due to the applicant purposely concealing from the Army Recruiter at the time of enlistment his outstanding felony warrant issued by the State of California for auto theft, forgery and conspiracy.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 7, paragraph 7-17, of that regulation provides, in pertinent part, that a fraudulent entry is the procurement of an enlistment, reenlistment, or period of active service through any deliberate material misrepresentation, omission, or concealment of information which, if known and considered by the Army at the time of enlistment or reenlistment, might have resulted in rejection. This includes all disqualifying information requiring a waiver. A soldier who concealed his or her conviction by civil court of a felonious offense normally will not be considered for retention. Soldiers separated under this chapter may be awarded an honorable discharge, or a general discharge, or a discharge under other than honorable conditions. If in an entry level status the characterization will be uncharacterized.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service, as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. Contrary to the applicant’s contention the evidence of record shows that the applicant, acting on his own, purposely concealed from Army Recruiters at the time of enlistment, his outstanding felony warrant issued by the State of California, for auto theft; forgery of an Access Card; and Conspiracy. The Board concluded that the discrediting entries in the applicant's record were not outweighed by prior or subsequent service of sufficient merit to warrant an upgrade of the discharge being reviewed. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
