PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a . Evidence of record shows that on 21 May 2002, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 7, AR 635-200, by reason of fraudulent entry, with an honorable discharge. She was advised of her rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement on her own behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. The intermediate commanders reviewed the proposed discharge action and recommended approval with an honorable discharge. On undated, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an honorable discharge.

         b. On 17 July 2002, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 5 months, and 11 days of active military service.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 7, paragraph 7-17, of that regulation provides, in pertinent part, that a fraudulent entry is the procurement of an enlistment, reenlistment, or period of active service through any deliberate material misrepresentation, omission, or concealment of information which, if known and considered by the Army at the time of enlistment or reenlistment, might have resulted in rejection. This includes all disqualifying information requiring a waiver. A soldier who concealed his or her conviction by civil court of a felonious offense normally will not be considered for retention. Soldiers separated under this chapter may be awarded an honorable discharge, or a general discharge, or a discharge under other than honorable conditions. If in an entry level status the characterization will be uncharacterized.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard her testimony. The Board noted the applicant’s contentions regarding her recruiter; however, she did not provide any conclusive evidence to support her position. The Board noted inconsistencies between her own statements made in the official record and what she provided in testimony. There is also no evidence that she ever applied for a hardship discharge. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief.
