PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 23 February 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 7, Paragraph 7-17b, AR 635-200 by reason of fraudulent entry. On 28 February 1990, Orders 040-604, DA, HQ, US Army Training Center and Fort Jackson, SC, discharged the applicant from the Regular Army, effective date: 5 March 1990. The applicant was available to sign his DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 7, Paragraph 7-17b, AR 635-200 by reason of fraudulent entry with a characterization of service of uncharacterized. Furthermore, the DD Form 214 shows a Separation Code of JDA (i.e., fraudulent entry). The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 5 March 1990, the applicant was discharged. He was credited with
1 month, and 5 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 7, Paragraph 7-17b, of that regulation provides, in pertinent part, that a fraudulent entry is the procurement of an enlistment, reenlistment, or period of active service through any deliberate material misrepresentation, omission, or concealment of information which, if known and considered by the Army at the time of enlistment or reenlistment, might have resulted in rejection. This includes all disqualifying information requiring a waiver. A soldier who concealed his or her conviction by civil court of a felonious offense normally will not be considered for retention. Soldiers separated under this chapter may be awarded an honorable discharge, or a general discharge, or a discharge under other than honorable conditions. If in an entry-level status the characterization will be uncharacterized.

(1-4) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The available records do not contain all the facts and circumstances leading to the applicant’s discharge in question. However, the available evidence shows that command initiated the applicant’s separation under the provisions of Chapter 7, Paragraph 7-17b, AR 635-200 by reason of fraudulent entry. Additionally, the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge From Active Duty) which was authenticated by the applicant’s signature. That DD Form 214 indicates that the applicant was discharged under the provisions of Chapter 7, Paragraph 7-17b, AR 635-200 by reason of fraudulent entry with service uncharacterized. Notwithstanding the applicant’s contentions, barring any evidence to the contrary, the Board presumes administrative regularity in the applicant’s discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
