SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. All the facts and circumstances leading to the applicant’s
discharge are not in the available records. Evidence of record shows that
on 9 March 2002, DA, 63d Regional Support Command, Los Alamitos,
California, Orders 02-068-014 discharged the applicant from the United
States Army Reserve, with a characterization of service of general, under
honorable conditions. He was discharged effective 9 March 2002, which was
prior to the expiration of his enlistment obligation.
b. On 9 March 2002, the applicant was discharged. At the time of
discharge, the applicant had completed 4 years and 27 days of military
service in the period under review.
c. Although the specific facts and circumstances are not in the
available records the applicant’s statement implies that his discharge was
based on his lack of attendance to scheduled drills with his USAR unit. He
states that he was unable to gain promotion within his civilian workplace
while actively drilling. Furthermore, he states that his decision to stop
drilling resulted in receiving a promotion in his civilian employment.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 135-178
provides for the separation of members of the Army National Guard and Army
Reserve when it is determined that a service member is unqualified for
further military service.

propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.

(1) The issue is rejected. Except for the applicant’s admission
that he was discharged from the Reserve of the Army for ceasing to attend
drills, the applicant’s record is void of the specific facts and
circumstances concerning the events that led to his discharge from the
Reserve of the Army. However, the record contains a properly constituted
order (i.e., Orders 02-068-014) dated 9 March 2002, that shows that the
Department of the Army, 63d Regional Support Command, Los Alamitos,
California, discharged the applicant under the provisions of AR 135-178
(NA) from the United States Army Reserve, with a characterization of
service of general, under honorable conditions. In view of the foregoing,
the Board presumes administrative regularity in the discharge process. In
the absence of evidence to the contrary, the Board was satisfied that all
requirements of law and regulation were met and the rights of the applicant
were fully protected throughout the separation process. The Board noted
the applicant’s contentions; however, did not find said contentions
sufficiently mitigating to warrant an upgrade of the discharge under
review. Furthermore, a change to reentry eligibility (RE) codes does not
fall within the purview of this Board. The Board, being convinced that the
reason for discharge and the characterization of service were both proper
and equitable, voted to deny relief.
