                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.  Evidence
of record shows that on 22 September 2003, DA, HQ, 88th Regional Support
Command, Fort Snelling, Minnesota, Orders 03-265-00022, discharged the
applicant from the United States Army Reserve, effective date 22 September
2003, with a characterization of service of general, under honorable
conditions.

      b.  On 22 September 2003, the applicant was discharged.  At the time
of discharge, the applicant had completed 2 years of military service in
the period under review and had a total of 9 years, 10 months, and 22 days.

      c.  The applicant’s OMPF does not contain any specific information
leading to his discharge.  In the applicant’s statement accompanying his DD
Form 293 (Application for the Review of Discharge), he states that he
failed PT tests and missed some drills.  However, also noted is the fact
that he enlisted on 010922 for two (2) years and was subsequently
discharged beyond his ETS date of 030921.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 135-178
provides for the separation of members of the Army National Guard and Army
Reserve when it is determined that a service member is unqualified for
further military service.

        (1)  The issue is accepted.  The Board noted that the applicant was
administratively discharged beyond the expiration term of service date
established in his enlistment contract.  Accordingly, the Board found the
discharge improper, and voted to grant relief in the form of an upgrade of
characterization of service to fully honorable and to change the narrative
reason for discharge to Secretarial Authority.

      b.  Equity:      The applicant has not submitted an issue of equity
                   and the ADRB has not otherwise relied upon an issue of
                   equity to change the discharge.  The major factors upon
                   which the discharge was based are set forth in Parts III
                   and IV of this decisional document.
