                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the facts and circumstances leading to the applicant’s
discharge are not in the available records.  Evidence of record shows that
on 17 July 2002, DA, HQ, 63d Regional Support Command, Los Alamitos,
California, Orders 02-198-00039 discharged the applicant from the United
States Army Reserve, with service uncharacterized.  He was discharged
effective 17 July 2002, which was prior to the expiration of his enlistment
obligation.

      b.  On 17 July 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years and 23 days of military
service in the period under review.

      c.  Although the specific facts and circumstances are not in the
available records the applicant’s statement implies that his discharge was
based on his lack of attendance to scheduled drills with his USAR unit.  He
states that he was unable to meet his drill commitments in California
because he was with his fiancée (AD Air Force) at Tinker AFB, Oklahoma,
assisting her in recovering from an on-the-job foot injury.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 135-178
provides for the separation of members of the Army National Guard and Army
Reserve when it is determined that a service member is unqualified for
further military service.

        (2)  The issue is accepted.  The Board carefully examined the
available records for the period of enlistment under review.  The evidence
of record shows that the applicant had attained a military occupational
specialty and was discharged after having completed more than 3 years of
military service in the Reserve of the Army.  In view of the foregoing, at
the time of discharge, the applicant was no longer in an entry-level status
(i.e., the first 180 days of continuous active duty service) and his
service required a characterization.  Therefore, the Board determined that
the characterization of service was and is improper.  Accordingly, the
Board voted to grant partial relief by changing the characterization of
service to fully honorable.  However, not having all the facts and
circumstances pertaining to the specific reason for separation, the Board
presumed administrative regularity and voted not to change it.

      b.  Equity:      The applicant has not submitted an issue of equity
                   and the ADRB has not otherwise relied upon an issue of
                   equity to change the discharge.  The major factors upon
                   which the discharge was based are set forth in Parts III
                   and IV of this decisional document.
