PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 12 September 1988, the applicant was charged with wrongfully using cocaine between (880730-880808). On 16 September 1988, the applicant voluntarily tendered his resignation from the service under the provisions of Chapter 5, AR 635-120, for the good of the service. The chain of command recommended approval of the resignation for the good of the service with issuance of an under other than honorable conditions discharge. On 27 October 1988, The Ad Hoc Review Board recommended that the applicant’s resignation be accepted with issuance of an under other than honorable conditions discharge. On 27 October 1988, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed that the applicant be discharge with a characterization of service of under other than honorable conditions.

         b. On 16 December 1988, the applicant was discharged. At the time of discharge, the applicant had completed 6 years, 3 months, and 24 days of active military service in the period under review and had a total of 6 years, 6 months and 25 days of active military service.

Legal/Regulatory Basis for Separation Action : Army regulation 635-120 sets forth the basic authority for the separation of officer personnel. Under the provisions of Chapter 4, an officer may submit a resignation for the good of the Service when court-martial charges are preferred against the office or while under suspended sentence to dismissal under the reasons outlined in AR 635-100, paragraph 5-11a(7). Army policy states that although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. Although the Board does not condone the applicant’s misconduct, the Board determined that the applicant had service of sufficient merit to partially overcome the characterization of service granted. Given the above, the Board determined that the characterization of service is inequitable. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board found that the reason of discharge was both proper and equitable, and voted not to change it.
