PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 31 March 1993, the applicant was charged with wrongfully using marijuana. On 21 April 1993, the applicant voluntarily tendered his resignation from the Service under the provisions of Chapter 5, AR 635-120, for the good of the Service. The chain of command recommended approval of the resignation for the good of the Service with issuance of an under other than honorable conditions discharge. On 11 May 1993, The Ad Hoc Review Board recommended that the applicant’s resignation be accepted with issuance of an under other than honorable conditions discharge. On 24 May 1993, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed that the applicant be discharged with an under other than honorable conditions.

         b. On 21 June 1993, the applicant was discharged. He was credited with
8 years, 2 months, and 19 days active service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-120 sets forth the basic authority for the separation of officer personnel. Under the provisions of Chapter 5, an officer may submit a resignation for the good of the Service when court-martial charges are preferred against the officer or while under suspended sentence to dismissal under the reasons outlined in AR 635-100, paragraph 5-11a(7). Army policy states that although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(4) The issue is accepted . The Board carefully reviewed the applicant’s record during the period of service under review. There was a full consideration of all his faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The evidence of record shows that the applicant was charged with the wrongful use of marijuana punishable under the Uniform Code of Military Justice with a punitive discharge. The Board found that the length and quality of the applicant’s service mitigated his misconduct. In view of the foregoing, the Board determined that the characterization of service was inequitable and did not warrant the granting of an under other than honorable conditions discharge. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board determined that the reason for discharge was proper and equitable and voted not to change it.

(1), (2), and (3) The issues are rejected. The Board noted the applicant’s contentions that he had 8 years of honorable and faithful service and only used marijuana during a period of stress. However, the Board concluded that the discrediting entries constituted a departure from the standards of conduct expected of Army personnel. Having examined all the circumstances,
t he Board concluded that by his misconduct, the applicant diminished the overall quality of his service below that meriting a fully honorable discharge.
