                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the facts and circumstances leading to the applicant’s
discharge are not in the available records.  Evidence of record shows that
on 8 February 2002, DA, U.S. Army, 90th RSC, Maurice L. Britt USARC, North
Little Rock, Arkansas, Orders 02-039-071 discharged the applicant from the
United States Army Reserve, with service uncharacterized.  She was
discharged effective 8 February 2002, which was prior to the expiration of
her enlistment obligation.

      b.  On 8 February 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 6 months, and 25 days of
military service in the period under review.

      c.  Although the specific facts and circumstances are not in the
available records, evidence of record shows that on 3 August 1999, the
applicant was ordered to initial active duty for training (IADT) for basic
combat training (BCT), followed by advanced individual training AIT).  On
or about 23 October 1999, she sprained both ankles while on a road march,
aggravated by continued training.  She was subsequently authorized an early
release from training due to a temporary medical disqualification.  On 24
November 1999, at the request of the State of Texas, the applicant was
released from IADT and returned to her Army Reserve unit for recovery
period.  The record also contains temporary and subsequent permanent
physical profiles, which precluded her from completing her BCT
requirements.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 135-178
provides for the separation of members of the Army National Guard and Army
Reserve when it is determined that a service member is unqualified for
further military service.

issues of propriety and/or equity:

      a.  Propriety:   The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  The applicant’s record is void of the
specific facts and circumstances concerning the events that led to a
discharge from the United States Army Reserve.  However, the applicant’s
record contains a properly constituted order, dated 8 February 2002,
discharging the applicant from the United States Army Reserve under the
provisions of AR 135-178 with service uncharacterized.  Barring
corroborated evidence to the contrary, the Board presumed Government
regularity in the discharge process.  The Board was satisfied that all
requirements of law and regulation were met and the rights of the applicant
were fully protected throughout the separation process.  The available
records indicate that the applicant never completed her initial active duty
for training and was never awarded a military occupational specialty (MOS).
 In view of the foregoing, the applicant remained in an entry-level status
and her service was properly uncharacterized.  Army Regulations provide
that, except in cases of serious misconduct, a soldier’s service will be
uncharacterized when separation is initiated while the soldier is in entry-
level status.  The Board noted the applicant’s contentions; however, did
not find said contentions supported by the available evidence of record.
The Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.

      b.  Equity:      The applicant has not submitted an issue of equity
                   and the ADRB has not otherwise relied upon an issue of
                   equity to change the discharge.  The major factors upon
                   which the discharge was based are set forth in Parts III
                   and IV of this decisional document.
