PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 6 December 1994, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of
misconduct—conviction by a civil court, with an under other than honorable
conditions discharge. The specific reason was his conviction by a foreign
tribunal for robbery and stabbing of a taxi driver. He was advised of his
rights. The applicant waived, but received legal counsel, was advised of
the impact of the discharge action, waived his right to a board, and did
not submit a statement in his own behalf. The unit commander subsequently
recommended separation from the service and waiver of further
rehabilitative efforts. The intermediate commanders reviewed the proposed
discharge action and recommended approval of the separation action with an
under other than honorable conditions discharge. The separation authority
waived further rehabilitative efforts and directed that the applicant be
discharged with a characterization of service of under other than honorable
conditions.
b. On 22 August 1998, the applicant was discharged. At the time of
discharge, the applicant had completed 5 years, 1 month, and 29 days of
active military service (which included 3 years, 8 months, and 7 days in
civilian confinement) in the period under review.
c. On 9 December 1994, the applicant was placed in civilian
confinement as a result of his civil conviction. The execution of his
discharge was suspended pending completion of his term of imprisonment. He
was subsequently released from imprisonment on 15 August 1998.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct. Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave. Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed. Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. The evidence of record does not support the
applicant’s contentions and the applicant has provided no independent
corroborating evidence in support of his contentions. The evidence of
record shows that the applicant was convicted by a foreign tribunal for
robbery and stabbing of a taxi driver. As a result of his sentence the
applicant was placed in civil confinement and subsequently served 3 years,
8 months, and 7 day in civil confinement. The applicant was properly
processed for separation under the provisions of Chapter 14, AR 635-200, by
reason of misconduct-conviction by civil court and discharged upon his
release from civil confinement. The Board determined that the applicant's
discharge was appropriate because the quality of his service was not
consistent with the Army's standards for acceptable personal conduct and
performance of duty by military personnel. By his misconduct and poor duty
performance, the applicant diminished the quality of his service below that
meriting a fully honorable or general discharge. The Board, being
convinced that the reason for discharge and the characterization of service
were both proper and equitable, voted to deny relief.
