PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 11 May 1994, the applicant requested discharge effective 28 May 1994 due to hardship under the provisions of Chapter 6, AR 635-200, by reason of being a sole parent and the family care plan was not working. The unit commander recommended approval. On 20 May 1994, the separation authority approved the request for discharge under the provisions of Chapter 6-3b(2), AR 635-200, with an adjusted ETS date of 28 May 1994 and directed that the applicant be discharged with an honorable discharge and transferred to the Individual Ready Reserve (IRR).

         b. On 3 June 1994, the applicant was discharged. At the time of discharge, the applicant had 1 year, 9 months, and 17 days service on her current enlistment.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 6-3b(2) provides that soldiers who are sole parents, and whose children under 18 years of age reside within the household may apply for separation under hardship. A “sole parent” is defined as a parent who is single by reason of never having been married, or is divorced or legally separated and has been awarded child custody by judicial decree or court order, or is a widow or widower. Soldiers separated under this chapter may be awarded an honorable or a general discharge. If in an entry-level status the characterization will be uncharacterized.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The applicant contends that the narrative reason for discharge on her DD 214 is incorrect, and that due to this error she is unable to obtain her Montgomery GI Bill benefits through the Department of Veterans Affairs (VA). The evidence of record shows that the applicant requested discharge under the provisions of Chapter 6-3b(2), AR 635-200, for hardship because as a sole parent she was unable to furnish a valid Dependent Care Plan. Per her request, the applicant was separated by reason of “Parenthood.” The Board found no errors in the applicant’s DD 214 and determined that the DD 214 properly reflects the reason and authority for discharge. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief .
        
         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
