PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 26 January 1995, after consultation with the applicant, the troop chaplain (CPT) recommended discharge due to hardship. On 12 April 1995, the applicant requested to be administratively separated from the Army due to sole parent, under the provisions of Chapter 6, AR 635-200, and submitted a statement in her own behalf. The unit commander recommended approval. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with an honorable discharge. On 16 May 1995, the separation authority approved the applicant’s request for separation, and directed that the applicant be discharged with an honorable discharge.

         b. On 30 May 1995, the applicant was released from active duty and assigned to the US Army Reserve Control Group (Annual Training) USARPERCEN, St. Louis MO. At the time of release, the applicant had 11 months, and 16 days, service on her current enlistment.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 6-3b(2) provides that a soldier who are sole parents, and whose children under 18 years of age reside within the household may apply for separation under hardship. Separation is based on who is single by reason of never having been married, or is divorced or legally separated and has been awarded child custody by judicial decree or court order, or is a widow or widower.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted the applicant requested discharge under the provisions of Chapter 6, AR 635-200 for an inability to perform her prescribed duties due to parenthood. This voluntary separation was appropriate since the command determined that the applicant’s parental obligations interfered with the fulfillment of military responsibilities. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Accordingly, the Board determined that the reason for discharge was both proper and equitable and voted not to change it.
