PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 28 June 1995, the applicant was found guilty by a special court-martial of being absent without leave, (950525-950530); absent from unit without authority (950519); FTG, three specifications (950503); (950506); (950507); DOLO, of a non commissioned officer, two specifications (950503); (950525). He was sentenced to be discharged with a bad conduct discharge, confinement for a period of 75 days, forfeit of $550.00 pay per month for six (6) months, and reduction to E1. On
17 July 1995. The sentence was approved. On 30 April 1996, the sentence having been affirmed pursuant to Article 71(c) having been complied with, the bad conduct discharge was ordered to be executed.

         b. On 30 April 1996, the applicant was discharged with a bad conduct discharge, under the provisions of Chapter 3, AR 635-200, by reason of court-martial, other. He was credited with 2 years, 5 months, and 6 days active service on the enlistment under review.

         c. There is no DD 214 of record. The applicant indicates that he was advised by the 18
th Airborne Military Personnel Center Separation Transfer Point that he would receive a copy of his DD 214 within a year. Upon further research at the Enlisted Records and Evaluation Center, it appears that the applicant was not properly discharge from the service and a DD 214 was never completed. The Board president has determined that there is sufficient evidence of record upon which to consider the applicant’s request.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 3, Section IV, establishes policy and procedures for separating members with a dishonorable or bad conduct discharge; and provides that a soldier will be given a bad conduct discharge pursuant only to an approved sentence of a general or special court-martial; and that the appellate review must be completed and the affirmed sentence ordered duly executed.
