PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 12 October 1995, the unit commander notified the applicant of his initiation of her involuntary separation action under the provisions of Chapter 5, AR 635-200 by reason of parenthood, with an honorable discharge. The applicant acknowledged notification, waived legal counsel, was advised of the impact of the discharge action, and submitted a statement in her own behalf. The unit commander subsequently recommended approval of honorable discharge and forwarded it through command channels to the separation authority. The intermediate commander reviewed the proposed discharge action and recommended approval with an honorable discharge. On 20 October 1995, the separation authority directed that the applicant be discharged with an honorable discharge.

         b. On 17 November 1995, the applicant was discharged. She was credited with
7 months, and 7 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 5, paragraph 5-8, then in effect, provided the policy and outlined the procedures for separating individuals under the involuntary separation due to parenthood. Soldiers will be considered for involuntary when parental obligations interfere with fulfillment of military responsibilities.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board noted that the applicant was involuntarily separated under the provisions of Chapter 5, Army Regulation 635-200, by reason of parenthood with an honorable discharge. The evidence of record shows that the applicant was advised by her unit commander that she required an adequate family care plan. On 16 October 1995 the applicant authenticated a letter with her signature in which she informed her unit commander that she was unable to provide a Dependent Care Plan. Furthermore, she stated that she was unable to perform such duties as Charge of Quarters, field training exercises, and/or be available for worldwide deployments or assignments. The Board found no evidence that the applicant applied for a hardship discharge. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Additionally, the Board found no evidence of arbitrary or capricious action by command. The Board found the reason for discharge to be both proper and equitable and voted to deny relief.
