PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 26 August 1985, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l1, AR 635-200, by reason of entry level status performance and conduct, with an uncharacterized discharge. The applicant was advised of her rights, waived legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in her own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with an uncharacterized discharge. On 4 September 1985, the separation authority waived further rehabilitative efforts and directed that the applicant be separated with an uncharacterized discharge.

         b. On 6 September 1985, the applicant was separated with an uncharacterized discharge. At the time of discharge, the applicant had completed 5 months and
6 days of active military service.

         c. The applicant’s record shows that she completed just 5 months and 6 days of service and never advanced beyond the rank of private/E-1 while on active duty. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. However, there is an extensive disciplinary record for the short time the applicant served which includes her acceptance of two Article 15’s: the first on 24 July 1985, for being absent from class and remaining away until apprehended; and the second on 23 August 1985, for three specifications of disobeying lawful orders, and a specification of wrongfully having sexual intercourse with a man, not her husband. The unit commander processed the applicant for an entry level separation, citing her difficulty in coping with military life, her refusal to train, and her desire to do nothing but go home.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1), (2), and (3) The issues are rejected. The Board noted the applicant’s contentions that, in effect, her discharge was inequitable because the man she had an affair with was allowed to continue to serve; that her proficiency marks as a civil service employee have been good; and that she has been in no trouble for the past fourteen years. However, the Board noted from the evidence of record that the applicant received an uncharacterized separation while in an entry level status (ELS). The separation authority approved the applicant's discharge as entry level status, with the description of service as uncharacterized. A soldier is in entry level status for the first 180 days of continuous active duty. The purpose of the entry level status is to provide the soldier a probationary period. Soldiers who are found to lack the necessary motivation, adaptability, self-discipline, ability, or attitude to become productive soldiers may be expeditiously separated while in entry level status. An honorable discharge is rarely ever granted for an ELS. A fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty. The Board determined that no such unusual circumstances were present in the applicant’s record and her service did not warrant an honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

During review of this case it was noted that there was an administrative error contained in item 24 (Character of Service) of the DD Form 214 (Certificate or Release or Discharge from Active Duty) issued the applicant at discharge. DD Form 214.
