PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 2 April 1985, the applicant was charged with AWOL from (840605-850325). On 5 April 1985 the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial. In this request, the applicant admitted guilt to the offense, or a lesser included offense. Further, the applicant indicated that he understood that he could receive an under other than honorable conditions (UOHC) discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits. The applicant submitted a statement in his own behalf. The unit commander and intermediate commanders recommended approval of an under other than honorable conditions UOHC discharge. On 26 April 1985, the separation authority approved the discharge with an under other than honorable conditions discharge.

         b. On 15 May 1985, the applicant was discharged. At the time of discharge, the applicant had 1 month, and 22 days on his current enlistment and 293 days lost time.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (2) The issue is accepted. The Board carefully reviewed the applicant’s available record and the circumstances surrounding his discharge. Based on the evidence of record and the applicant’s statement, the Board determined that the applicant’s characterization of service was inequitable. In the absence of information to the contrary, the Board found the applicant’s explanation of the circumstances surrounding his discharge plausible and with merit. As a member of the US Army Reserve not having completed basic or advanced individual training, the applicant was in an entry-level status and could have been separated with an uncharacterized discharge at the time of his separation. The Board found nothing improper with the applicant’s current discharge, but based on the circumstances determined that a characterization of service under other than honorable conditions was inequitable. Accordingly, the Board voted to change the characterization of service to uncharacterized. The Board was satisfied that the reason for discharge was proper and equitable and voted not to change it.

(1) The issue is rejected. The evidence of record shows the applicant was charged with the commission of an offense punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The Board noted that, after consulting with defense counsel, the applicant voluntarily, and in writing, requested separation from the Army in lieu of trial by court-martial. In doing so, the applicant admitted guilt to the stipulated offenses under the UCMJ. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge. Additionally, the applicant’s entry level status mitigated against a more favorable discharge other than that cited in paragraph 2.b.(2) above. For a soldier in an entry level status, a fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct or performance of duty. The Board determined that no such circumstances were present in the applicant’s record.
