PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 21 November 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of her rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in her own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. The Staff Judge Advocate determined the separation action to be legally sufficient. On 30 November 1990, the separation authority directed that the applicant be discharged with a GD.

         b. On 10 December 1990, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 11 months, and 6 days of active service on her current enlistment and 5 years, 10 months, and 20 days of inactive service in the United States Army Reserve.

         c. The applicant’s record shows that she completed almost 3 years of active duty; she attained the rank of specialist/E-4; and she earned an Army Achievement Medal and the Army Service Ribbon. Her disciplinary record includes her acceptance of 2 Article 15’s: the first on 29 January 1990 for failing to go to her prescribed place of duty, and two specifications of disobeying lawful orders; and the second on 21 September 1990 for disobeying a lawful order and for being disrespectful in language to an NCO which resulted in her reduction to private first class/E-3. The unit commander processed the applicant for separation citing the offenses contained in the Article 15’s outlined above and her failure to respond to several counseling sessions.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) and (2) The issues are rejected. The Board noted the applicant’s contentions that, in effect, personal problems impaired her ability to serve; and that she is now a good citizen worthy of an upgrade to her discharge. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the applicant's discharge was appropriate. The applicant’s quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that her service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
