                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 6 August 1990, Orders 207-6, DA,
55th Personnel Service Company; APO, New York, discharged the applicant
from the regular Army, effective date: 29 August 1990.  The record contains
a properly constituted DD form 214 (Certificate of Release or Discharge
from Active Duty), which was authenticated by the applicant’s signature.
His DD Form 214 indicates that he was discharged under the provisions of
Chapter 14, AR 635-200, paragraph 12b by reason of misconduct, with a
characterization of service of honorable.  Furthermore, the DD Form 214
shows a Separation Code of JKM (i.e., misconduct-pattern of misconduct).
The specific facts and circumstances leading to the applicant’s discharge
are not contained in the available records.

      b.  On 29 August 1990, the applicant was discharged.  At the time of
discharge, the applicant had completed 11 months, and 4 days of active
military service in the period under review and had a total of 5 years, and
15 days of active military service.

      c.  It appears that the applicant’s discharge was approved as a
general, under honorable conditions.  However, someone involved in the
discharge process erroneously changed the applicant’s characterization of
service to honorable on the DD Form 214.  It is the policy of the Board not
to correct an administrative error if the correction would result in a less
favorable action to the applicant.  Therefore, the Board will not change
the applicant’s characterization of service on the current DD Form 214.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (2)  The issue is accepted.  Regulations currently in effect list
the reason for the applicant’s discharge as misconduct.  Accordingly, the
Board voted to change the narrative reason on the DD Form 214 to
misconduct.  Other than the foregoing modification to the reason for
separation, the Board found the reason for separation to be both proper and
equitable and voted not to change it further.

        (1)  The issue is rejected.  The applicant’s record is void of the
specific facts and circumstances concerning the events that led to his
discharge from the Army.  However, the applicant’s record does contain a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty).  This document identifies the reason and characterization of
the discharge and the Board presumed Government regularity in the discharge
process.  That DD Form 214 indicates that the applicant was discharged
under the provisions of Chapter 14, AR 635-200, Paragraph 14-12b, by reason
of misconduct-pattern of misconduct, with a characterization of service of
honorable.  The Board was satisfied that all requirements of law and
regulation were met and the rights of the applicant were fully protected
throughout the separation process.  See response to issue 2 above.
